National Workplace Relations Consultative Council Act 2002 .Dated 13 May 2004

These Regulations are the
National Workplace Relations Consultative Council Regulations 2004 .
These Regulations commence on the date of their notification in the
Gazette .
In these Regulations:
Act means theNational Workplace Relations Consultative Council Act 2002 .
relevant determination means:
(a) Determination 2004/03 made by the Remuneration Tribunal on 8 March 2004, as in force from time to time; or
(b) any determination made by the Remuneration Tribunal that supersedes Determination 2004/03; or
(c) if a determination mentioned in paragraph (a) or (b) is revoked without being superseded by another determination — the revoked determination as in force immediately before its revocation.
(1) A member is authorised to receive travelling allowance for:
(a) travel to attend a meeting of the Council; or
(b) other travel related to the purposes of the Council.
(2) The rate of travelling allowance is equal to the rate of travelling allowance that would be payable at the Tier 2 rate to a part-time holder of public office under the relevant determination when the travel takes place.
Note An invited representative is entitled to travelling allowance as if he or she were a member: see subsection 10A (4) of the Act.
5 Travelling allowance for persons nominated to attend meetings
(1) A person nominated under subsection 10 (1) or (2) of the Act to attend a meeting of the Council in place of a member is authorised to receive travelling allowance for travel to attend the meeting.
(2) The rate of travelling allowance is equal to the rate of travelling allowance that would be payable at the Tier 2 rate to a part-time holder of public office under the relevant determination when the travel takes place.
(1) A member of a committee of the Council constituted under subsection 12 (1) of the Act is authorised to receive travelling allowance for:
(a) travel to attend a meeting of the committee; or
(b) other travel related to the purposes of the committee.
(2) The rate of travelling allowance is equal to the rate of travelling allowance that would be payable at the Tier 2 rate to a part-time holder of public office under the relevant determination when the travel takes place.
(1) A person who wishes to receive travelling allowance under regulation 4, 5 or 6 must give the Department a claim, in writing, for the allowance.
(2) The claim must specify the travel to which the claim relates.
(3) The Secretary must make arrangements for determining claims made under subregulation (1) and for paying amounts determined to be payable.
