Proposed protected action ballot by employees of Entapack Pty Ltd.

[1] This is an application for a protected action ballot of members of the National Union of Workers (NUW) employed by Entapack Pty Ltd (Entapack) which was filed by the NUW on 3 May 2012.

[2] My Associate emailed Mr Wayne Harbor of Entapack on 3 May 2012 asking Entpack to indicate whether it would be objecting to the application.

[3] Ms Henderson of the Australian Industry Group, the representative of Entpapack in this matter, responded by email on 4 May 2012 advising that the company does not seek to oppose the application.

[4] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[5] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the NUW has issued in conjunction with this decision.
