Application by the National Union of Workers, New South Wales Branch for revocation of a protected action ballot Order

[1] On 23 March 2011, upon the application of the National Union of Workers, New South Wales Branch (NUWN), Fair Work Australia (FWA) made a protected action ballot Order [PR507728], (the Order). The Order was made in respect of specified employees of Woolstar Pty Ltd, (the employer). That Order was subsequently varied by Further Order of FWA issued on 14 April 2011 [PR508486] (the Further Order).

[2] On 4 May 2011, the NUWN made application pursuant to s.448 of the Fair Work Act 2009 (the Act), for revocation of the Order.

[3] The Order, as varied by the Further Order, at point 4, stated that the protected action ballot is to close no later than 23 May 2011.

[4] Therefore, pursuant to subsection 448(2) of the Act, FWA must revoke the Order. A Revocation Order [PR509005] is issued separately.
