Alteration of other rules of organisation.

[1]        On 1 July 2015 the National Tertiary Education Union (the organisation) lodged with

the Fair Work Commission (the Commission) a notice and declaration setting out particulars

of alterations to its rules.

[2]        The particulars set out alterations to the word ‘Indigenous’ wherever appearing to

reflect ‘Aboriginal and Torres Strait Islander’ bar Rules 18.3 D, 18.3 E and 27.14. The

alterations are to the following rules:

4, 17, 18, 27, 31, 36, 69, 70B, 70D, 80, Schedule E, Schedule F

[3]        On the information contained in the notice, I am satisfied the alterations have been

made under the rules of the organisation.

[4]        On 27 October 2015 the organisation lodged with the Commission a further notice and

declaration setting out particulars of alterations to its rules.

[5]        The particulars set out alterations to Rule 21. The alterations provide for the

temporary occupation of offices when the incumbent is absent for a specified period of time.

[6]        On the information contained in the notice, I am satisfied the alterations have been

made under the rules of the organisation.

[7]        In my opinion, both sets of alterations comply with and are not contrary to the Fair

Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and

enterprise agreements, and are not otherwise contrary to law. I certify accordingly under

subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
