REGULATIONS UNDER THE NATIONAL SERVICE ACT 1951-1966.*

I, THE GOVERNOR GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Service Act 1951-1966.

Amendments of the National Service Regulations

Lost, destroyed and defaced certificates.

1. Regulation 14 of the National Service Regulations is amended—

(a)by omitting from sub-regulation (1.) the words “or to the District Employment Officer at the District Employment Office specified in the certificate”;

(b) by inserting after sub-regulation (1.) the following sub-regulation:—

“(1aa.) It is a defence to a prosecution for a failure to comply with the last preceding sub-regulation if the person charged proves that he notified the fact that his certificate of registration had been lost, destroyed or defaced to a District Employment Officer.”;

(c) by omitting from sub-regulation (1a.) the words “or District Employment Officer”;

(d)by omitting from sub-regulation (1a.) the words “the last preceding sub-regulation” and inserting in their stead the words “sub-regulation (1.) of this regulation”;

(e) by omitting from sub-regulation (2.) the words “or the District Employment Officer”;

(f) by omitting from sub-regulation (3.) the words “or the District Employment Officer otherwise determines, a fee of Two shillings and sixpence” and inserting in their stead the words “otherwise determines, a fee of Twenty-five cents”;

(g)by omitting from sub-regulation (4.) the words “or to the District Employment Officer”; and

(h)by adding at the end thereof the following sub-regulation:—

“(5.) Where a notification under sub-regulation (1.) of this regulation is given to a District Employment Officer, the District Employment Officer may exercise any of the powers conferred on a Registrar by this regulation.”.

Surrender of certificate by person not called-up for service.

2. Regulation 16 of the National Service Regulations is amended—

(a)by omitting the words “or to the District Employment Officer at the District Employment Office specified in the certificate”; and

(b)by adding at the end thereof the following sub-regulation:—

“(2.) It is a defence to a prosecution for a failure to comply with the last preceding sub-regulation if the person charged proves that he posted or delivered his certificate of registration to a District Employment Officer.”.

Death of registered person.

3. Regulation 17 of the National Service Regulations is amended by omitting the words “to the District Employment Officer at the District Employment Office specified in the certificate”, and inserting in their stead the words “to a District Employment Officer”.

Manner of making application.

4. Regulation 40 of the National Service Regulations is amended by omitting from sub-regulation (1.) the words “to the District Employment Officer at the District Employment Office specified in the applicant’s certificate of registration” and inserting in their stead the words “to a District Employment Officer”.

First Schedule.

5. The First Schedule to the National Service Regulations is amended—

(a)by omitting Form 1; and

(b) by omitting from Form 2 the words “Your District Employment Office for the purpose of the National Service Regulations is”.
