REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939–1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939–1940.

Amendments of the National Security (Supply of Goods)

Regulations. 

Power to require delivery of goods.

1. Regulation 4 of the National Security (Supply of Goods) Regulations is amended—;

(a) by omitting from sub-regulations (1.) and (1a.) the words “Minister or to such person” and inserting in their stead the words “Commonwealth at such place”;

(b) by inserting after sub-regulation (1a.) the following sub-regulation:—

“(1b.) Where, for the purpose of enabling him to manufacture or produce any goods for supply, either directly or indirectly, to the Commonwealth, any person has requested some other person who manufactures or produces goods or who, in the opinion of the Minister, is capable of manufacturing or producing goods, or who deals in or has control of any goods, to enter into a contract for the manufacture, production or supply, and delivery to, that first-mentioned person, on terms which, in the opinion of the Minister, are fair and reasonable, and that other person has refused or failed to enter into that contract, the Minister may, by order in writing, require that other person to manufacture, produce or supply, and deliver to such person as is specified in the order, such goods as are so specified and within such period as is so specified”; and

(c) by omitting from sub-regulation (2.) the word “two” and inserting in its stead the word “three”.

Price of or remuneration for delivery of goods.

2. Regulation 5 of the National Security (Supply of Goods) Regulations is amended—

(a)by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) The price or remuneration to be paid by the Commonwealth, or by the person to whom goods are delivered in pursuance of an order issued under sub-regulation (1b.) of the last preceding regulation, as the case may be, for the supply and delivery of any goods in respect of which an order has been issued in pursuance of that regulation shall be such as is agreed between the person executing the order and the Commonwealth or person to whom the goods have been delivered in pursuance of an order under that sub-regulation, as the case may be, or, in default of agreement, such as is determined by arbitration in accordance with the succeeding provisions of this regulation:

Provided that the price or remuneration so agreed upon or determined shall not in any case exceed the maximum price (if any) fixed in respect of the goods by the Commonwealth Prices Commissioner in pursuance of the National Security (Prices) Regulations.”; and

(b)by omitting from sub-regulation (2.) the word “Minister” and inserting in its stead the words “Commonwealth, or person to whom the goods have been delivered in pursuance of an order under sub-regulation (1b.) of the last preceding regulation, as the case may be,”.
