National Security (Supplementary) Regulations (Amendment) (Cth)
STATUTORY RULES.
REGULATION UNDER THE NATIONAL SECURITY ACT 1939-1940.*

the Federal Executive Council, hereby make the following Regulation under the

Amendment of the National Security (Supplementary) Regulations.
The National Security (Supplementary) Regulations are amended by adding at the end thereof the following regulation:—
“95.—(1.) Duties of Customs and Excise shall not be chargeable on any goods—
(
a ) specified in item 19 in the Schedule to theCustoms Tariff 1933-1939 and in any Customs Tariff Proposals relating to that item; and(
b ) specified in items 6 (a), 6 (b), 8 and 14 in the Schedule to theExcise Tariff 1933-1939 and in any Excise Tariff Proposals relating to those items or any of them,
which are to be distributed, free of charge, by the Australian Comforts Fund or any other like organization approved by the Minister of State for Trade and Customs, to members of the Defence Force stationed in the Darwin area, provided that the packages in which the goods are distributed to individual members of the Defence Force so stationed are marked in a manner approved by that Minister.

“(2.) A person shall not sell, or cause to be sold, or (except by way of distribution, free of charge, to members of the Defence Force stationed in the Darwin area) otherwise dispose of, or cause to be disposed of, any tobacco, cigarettes or cigarette papers which, by virtue of the provisions of this regulation, are not chargeable with Duties of Customs and Excise.
“(3.) A person shall not, without lawful excuse (proof whereof shall lie upon him) have in his possession any tobacco, cigarettes or cigarette papers, which are not chargeable with Duties of Customs and Excise—
(
a ) except for the purpose of distributing the tobacco, cigarettes or cigarette papers, free of charge, to members of the Defence Force stationed in the Darwin area; or(
b ) unless the tobacco, cigarettes or cigarette papers were distributed to him while he was a member of the Defence Force so stationed.
“(4.) In this regulation—
“Darwin Area” means that portion of the Northern Territory of Australia lying North of a line running East and West through a point at a distance one hundred and eighty miles North of Alice Springs.”.
