REGULATION UNDER THE NATIONAL SECURITY ACT 1939-1943.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the National Security Act 1939-1943.

Amendment of the National Security (Supplementary) Regulations.

Administration of oaths, &c., to members of certain forces and of Civil Constructional Corps.

Regulation 63‡ of the National Security (Supplementary) Regulations is amended—

(a)by omitting the words “member of a fighting force” (wherever occurring) and inserting in their stead the words “person to whom this regulation applies”;

(b)by inserting in sub-regulation (1.), after the words “or equivalent rank”, the words “, or an officer in charge of a unit or detachment of the Royal Australian Air Force, who holds a rank below that of Flight Lieutenant,”,

(c)by inserting in sub-regulation (2.), after the word “rank,”, the words “and, in the case of an officer of an air force below the rank of Flight Lieutenant, the fact that he is in charge of a unit or detachment of the Royal Australian Air Force,”; and

(d)by inserting in sub-regulation (4.), after the words “rank of the officer” the words “, or, in the case of an officer of an air force below the rank of Flight Lieutenant, the fact that he was in charge of a unit or detachment of the Royal Australian Air Force,”.

(e) by inserting after sub-regulation (4.) the following sub-regulation:—

“(4a.) The powers conferred on officers by this regulation may, in relation to a person to whom this regulation applies who is a prisoner of war or is interned in any camp or place outside Australia, be exercised by any British subject who is for the time being the official representative of prisoners of war or other persons detained or interned in that camp or place, and, for the purposes of this sub-regulation, any reference in this regulation to the rank of the officer shall be read as a reference to the rank and the position of official representative held by any such British subject.”;

(f) by omitting from paragraph (c) of the definition of “member of a fighting force” in sub-regulation (6.) the word “or” (last occurring); and

(g) by inserting after paragraph (d)of that definition the following paragraph:—

“; or (e) a member of the Civil Constructional Corps established under the National Security (Allied Works) Regulations,”.
