REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940

National Security (Staff of War-time Boards) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Staff of War-time Boards) Regulations.

Administration.

2. These Regulations shall be administered by the Minister of State for Commerce.

Consequential amendments of certain Regulations.

3. The Regulations specified in the first column of the First Schedule to these Regulations are amended as set out in the second column of that Schedule.

Application of Regulations.

4. These Regulations shall apply to the Boards specified in the Second Schedule to these Regulations.

Definitions.

5. In these Regulations, unless the contrary intention appears—

“Board” means a Board to which these Regulations apply;

“officer” means officer of a Board;

“the Secretary”, in relation to a Board, means the Secretary to that Board, and, in relation to an officer, means the Secretary to the Board of which that officer is an officer, and, in either case, includes any person for the time being acting as Secretary.

Salaries of officers.

6.—(1.) An officer of a Board in relation to which the Third Schedule or any subsequent Schedule to these Regulations applies who is appointed, transferred or promoted to an office specified in Table A of the appropriate Schedule shall, subject to this regulation, be paid the minimum salary specified in that Table opposite to that office, or, where a maximum salary is also so specified, such higher salary (not exceeding that maximum salary) as the Board determines.

(2.) The Board may, if it is satisfied with the conduct, diligence and efficiency of an officer, grant such annual increments of salary (if any) as are specified in Table A in the appropriate Schedule opposite to the office occupied by that officer, but so that the annual salary of the officer shall not exceed the maximum salary so specified.

Variations of salary on account of variations in cost of living.

7.—(1.) In this regulation, “index number” means the weighted average retail price index number for the six State capital cities of the Commonwealth, as shown in the “Court” series of retail price index numbers published from time to time by, or at the direction of, the Commonwealth Court of Conciliation and Arbitration.

(2.) Where the index number for the six months ending on the thirty-first day of March or the thirtieth day of September in any year is less than 81.7, salaries payable in pursuance of these Regulations shall, unless, in the case of any particular officer, the Minister otherwise directs, as from the commencement of the first fortnightly pay period beginning in the month of July or the month of January (as the case may be) next following, be reduced by the amount shown in the following table opposite the index number group within which the index number falls:—

(3.) If the index number falls below 67.9, salaries shall be further reduced in the manner specified in the last preceding sub-regulation, that is to say, for each fall of 2.3 points in the index number salaries shall be reduced by Six pounds per annum in the case of adult males, Four pounds per annum in the case of adult females and Three pounds per annum in the case of officers under 21 years of age.

(4.) Where the index number for the six months ending on the thirty-first day of March or the thirtieth day of September in any year exceeds 83.9, salaries payable in pursuance of these Regulations shall, unless, in the case of any particular officer, the Minister otherwise directs, as from the commencement of the first fortnightly pay period beginning in the month of July or the month of January (as the case may be) next following, be increased by the

 

appropriate amount shown in the following table opposite the index number group within which the index number falls:—

(5.) If the index number rises above 97.7 salaries shall be further increased, in the manner specified in the last preceding sub-regulation, that is to say, for every rise of 2.3 points in the index number salaries shall be increased by Six pounds per annum in the case of adult males, Four pounds per annum in the case of adult females and Three pounds per annum in the case of officers under 21 years of age.

(6.) The following amounts shall, unless, in the case of any particular officer, the Minister otherwise directs, be added to salaries payable in pursuance of these Regulations:—

(7.) For the purposes of these Regulations (other than the last preceding regulation) the salary of an officer shall be deemed to be his salary as varied in pursuance of this regulation.

(8.) The first adjustment of salaries under this regulation shall be made as from the commencement of the first fortnightly pay period after the commencement of these Regulations, and shall be based on the index number for the six months ended on the thirtieth day of March, 1941, which shall be deemed to be 80.2.

Higher duties allowance.

8.—(1.) Where an officer is required to perform, for a continuous period of not less than one month, the whole or any portion of the duties of another officer, and the minimum salary of the position of that other officer is not less than the minimum salary of the position of the first-mentioned officer, the first-mentioned officer shall, in respect of the period during which he is required to perform those duties, be paid such allowance (if any) as the Minister, after recommendation by the Board, determines, provided that the rate of the allowance shall not exceed the difference between the salary of the first-mentioned officer and—

(a) the maximum salary of the position of the officer whose duties he is required to perform, where both a minimum and maximum salary of that position are prescribed; or

(b) in any other case, the salary of that position.

(2.) Where an officer is required to perform special duties he shall, in respect of the period during which he is required to perform those duties be paid such allowance (if any) as the Minister, after recommendation by the Board, determines.

 

Office hours.

9.—(1.) The hours of attendance to be observed by officers shall, subject to these Regulations, be—

(а) on days other than Saturdays—from Nine o’clock in the morning to Five thirty-three o’clock in the afternoon, with an interval of one hour for luncheon; and

(b) on Saturdays—from Nine o’clock in the morning to Twelve o’clock noon,

or, if the Board so determines, an equivalent number of hours worked on Mondays to Fridays.

(2.) Where the nature of the duties of an officer does not permit his attendance during the hours prescribed by, or determined under, the last preceding sub-regulation, the hours of attendance of that officer shall be as determined by the Board.

Duty after office hours.

10. The Secretary may, whenever necessary, require an officer to perform work after the usual hours.

Overtime.

11.—(1.) The Secretary may, if satisfied as to the necessity therefor, authorize the working of overtime by officers.

(2.) Overtime shall be recorded and shall be paid for subject to, and in accordance with, the provisions of these Regulations.

(3.) The hourly rate of overtime shall be based on time and a half, and shall be calculated in accordance with the following formula:—

(4.) The minimum rate of payment for overtime shall be One shilling per hour.

(5.) Payment for overtime shall be made in respect of—

(а) time worked in excess of forty-one and a half hours per week; and

(b) whether those hours have been worked or not, time worked on a Sunday or a holiday,

and shall be calculated to the nearest quarter of an hour of the total time so worked.

(6.) Officers in receipt of salary exceeding Four hundred and fifty pounds per annum shall not be entitled to receive payment for overtime.

Mealallowance.

12. Where an officer is required to remain on duty after six o’clock in the afternoon on a week day or after one o’clock on a Saturday or Sunday afternoon and is not paid overtime in respect thereof, he shall be granted a meal allowance of Three shillings if that attendance necessitates his obtaining a meal away from home.

Absence from duty during office hours.

13.—(1.) Except by express permission of the Secretary, an officer shall not absent himself from his office during office hours.

(2.) Where the Secretary permits an officer to absent himself from his office during office hours, the Secretary may grant leave, either with or without pay, in respect of that absence.

Recreationleave.

14.—(1.) The Board may grant recreation leave to an officer on the completion of each period of twelve months’ employment, for any period or periods not being in the aggregate less than twelve working days or more than eighteen working days (or, where a five day week is worked, not less than ten working days or more than fifteen working days) in respect of any period of twelve months.

 

(2.) Where an officer has been employed for not less than eight months and not more than twelve months, he may be granted leave on the scale specified in the last preceding sub-regulation proportionate to his length of service.

Absence from duty in case of illness or emergency.

15.—(1.) If an officer is prevented by illness or other emergency from attending for duty, he shall immediately report the fact to the Secretary.

(2.) Where an officer is prevented from attending for duty on account of illness, the Board may, on production of satisfactory medical evidence where the absence exceeds one day, grant to that officer leave of absence, with pay, in accordance with the following provisions:—

(a) The amount of leave which may be granted shall be ascertained by crediting the officer with the following periods of leave, which shall be cumulative:—

(b) To determine the leave for which an officer is eligible, the leave which has been granted during his service at rates of full pay, half pay, and third pay respectively shall be deducted from the period ascertained under the provisions of paragraph (a) of this sub-regulation.

(3.) Where an officer is prevented from attending for duty on account of illness, and is unable to produce satisfactory medical evidence, the Board may grant to that officer leave of absence, without pay, for such period as the Board determines.

Rate oftravellingallowance.

16. Officers who are required to travel on the business of the Board—

(a) shall be paid travelling allowance at the rate set out in Table B in the appropriate Schedule to these Regulations in respect of the first fourteen days’ residence in any place, and thereafter at such rates, not exceeding the rate so set out, as the Board determines; and

(b) shall be allowed first class fares, or, if the Board approves of the use of a private motor car, the officer shall be paid an allowance in accordance with the rates fixed by the Commonwealth Public Service Regulations for the time being in force.

Secretary to report to Board as to certain matters.

17. The Secretary shall report to the Board, whenever the necessity arises, any alterations which, in his opinion, are necessary or expedient for the more economical, efficient or convenient working of his office, and any alterations which, in his opinion, are necessary in the salaries or allowances of officers, and shall bring under the notice of the Board any matter in relation to an officer, or to the working of his office, with which he thinks it desirable that the Board should be acquainted.

 

Delegation.

18.—(1.) The Secretary to a Board may, in relation to any matter or class of matters, or in relation to any particular State or part of Australia, by writing under his hand, delegate all or any of his powers and functions under these Regulations (except this power of delegation) so that the delegated powers or functions may be exercised by the delegate with respect to the matters or class of matters, or the State or part of Australia, specified in the instrument of delegation.

(2.) Every delegation under this section shall be revocable at will, and no delegation shall prevent the exercise of any power or function by the Secretary concerned.
