STATUTORY RULES.

1943. No. 59.

REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

Amendments of the National Security (Staff of War-time Authorities) Regulations. 

Definitions.

1. Regulation 5 of the National Security (Staff of War-time Authorities) Regulations is amended by inserting after the definition of “officer” the following definition:—

“‘the authority’, in relation to an officer, means the authority of which that officer is an officer;”.

2. Regulation 6 of the National Security (Staff of War-time Authorities) Regulations is repealed and the following regulation inserted in its stead:—

Salaries of officers.

“6.—(1.) An officer who occupies an office specified in the Third Schedule to these Regulations shall, subject to this regulation, be paid the minimum salary specified in that Schedule opposite to that office, or, where a maximum salary is so specified, such higher salary (not exceeding that maximum salary) as the Board determines.

“(2.) An officer of an authority in relation to which the Fourth Schedule or any subsequent Schedule to these Regulations applies who occupies an office specified in Table A of the appropriate Schedule to

these Regulations shall, subject to this regulation, be paid the minimum salary specified in that Table opposite to that office, or, where a maximum salary is also so specified, such higher salary (not exceeding that maximum salary) as the authority determines.

“(3.) The authority may, if it is satisfied with the conduct, diligence and efficiency of an officer, grant such annual increments (if any) as are specified in the Third Schedule, or in Table A in the appropriate Schedule, as the case may be, opposite to the office occupied by that officer, but so that the annual salary of the officer shall not exceed the maximum salary so specified.”.

Overtime.

3. Regulation 11 of the National Security (Staff of War-time Authorities) Regulations is amended by omitting from paragraph (b) of sub-regulation (5.) the words “or a holiday”.

4. After regulation 12 of the National Security (Staff of Wartime Authorities) Regulations the following regulation is inserted:—

Duty on holidays.

“12a.—(1.) Where an officer is required by the Secretary to perform work on—

the first day of January,

the twenty-sixth day of January,

Good Friday or the next succeeding Saturday or Monday,

the twenty-fifth day of April,

the anniversary of the birthday of the Sovereign,

Christmas Day or the day next succeeding, or

any day observed as a holiday in lieu of any of those days,

the officer shall be paid, in addition to his salary—

(a) if his salary does not exceed Four hundred and fifty pounds per annum,

(i) for the work during a full day—an amount equal to his salary for one day; and

(ii) for the work during any period less than a full day, an amount which bears the same proportion to his salary for one day as the time worked bears to the hours of duty on one day, but so that the amount received shall not be less than one-half of his salary for one day; or

(b) in any other case, be granted time off for a period equal to the period during which the work was performed but not less than a half day.

“(2.) Where an officer is required by the Secretary to perform work on any day (not being a day specified in the last preceding sub-regulation) which is observed as a holiday at the place where the work is performed, and which the authority determines shall be deemed to be a holiday for the purposes of these Regulations, the authority may grant to the officer time-off for the same period as that during which the work was performed, but so that the time-off so granted shall not exceed four days in any calendar year.”.

Schedules.

5. The Second and subsequent Schedules to the National Security (Staff of War-time Authorities) Regulations are repealed and the following Schedules inserted in their stead:—

Commencement.

6.—(1.) Regulations 3 and 4 of these Regulations shall be deemed to have come into operation on the first day of January, 1942, but nothing in this sub-regulation shall deprive any person of any right to payment of overtime in respect of time worked prior to the commencement of this regulation on a holiday which is not a day specified in regulation 12a of the National Security (Staff of War-time Authorities) Regulations as inserted by these Regulations.

(2.) The Fourth and Eighth Schedules to the National Security (Staff of War-time Authorities) Regulations, as inserted by these Regulations, shall be deemed to have been in force from and including the twenty-seventh day of November, 1941.
