REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1943.*
I, THE
GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
under the

Amendments of the National Security (Shipping Co-ordination) Regulations.
1. After regulation 58 of the National Security (Shipping Co-ordination) Regulations the following regulation is inserted:—
“58a.—(1.) The Minister may appoint a person to be the Deputy Chairman of the Commission who shall hold office on such terms and conditions as the Minister determines.
“(2.) The Deputy Chairman shall be the chief administrative and executive officer of the Commission and shall be responsible to the Commission—
(
a ) for the prompt execution of the orders and directions of the Commission; and(
b ) for the efficient and economical administration of the affairs of the Commission.
“(3.) The Deputy Chairman of the Commission shall have and may exercise, during any illness or absence of, or as directed by, the Chairman of the Commission, all the powers and functions of the Chairman.
“(4.) Any act done by the Deputy Chairman of the Commission as such shall not, in any proceeding, be questioned on the ground that the occasion for the exercise of his powers had not arisen or had ceased”.

2. Regulation 59 of the National Security (Shipping Co-ordination) Regulations is amended—
(
a ) by omitting from sub-regulation (2.) the words “Executive Member” and inserting in their stead the words “Deputy Chairman”;(
b ) by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—“(3.) In the event of the illness or absence of the Chairman, the Deputy Chairman of the Commission shall be entitled to preside at meetings of the Commission and when so presiding shall be deemed to be a member of the Commission”;
(
c ) by inserting in sub-regulation (4.), after the word “Chairman”, the words “(or the Deputy Chairman if he is presiding at the meeting)”; and(
d ) by inserting in sub-regulation (5.), after the word “Chairman”, the words “(or the Deputy Chairman if he is presiding at the meeting)”.
3. Regulation 78 of the National Security (Shipping Co-ordination) Regulations is amended—
(
a ) by omitting from sub-regulation (5.) the words “Acting Chairman” and inserting in their stead the words “Deputy Chairman”; and(
b ) by adding at the end of that sub-regulation the words “and, for the purposes of sub-regulation (2.) of regulation 59 of these Regulations, be deemed to be the Chairman”
