REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939–1943.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939–1943.

Amendments of the National Security (Shipbuilding) Regulations,  

Definitions.

1. Regulation 6 of the National Security (Shipbuilding) Regulations is amended—

(a) by omitting the definition of “member” and inserting in its stead the following definition:—

“‘member’ means a member of the Board and includes the deputy of a member;”; and

(b) by omitting the definition of “the Deputy Chairman”.

Constitution and incorporation of Australian Shipbuilding Board.

2. Regulation 7 of the National Security (Shipbuilding) Regulations is amended—

(a) by omitting paragraph (b)of sub-regulation (1.) and inserting in its stead the following paragraphs:—

(b)the Director of Shipbuilding;

(ba) a person appointed on the nomination of the Naval Board;”; and

(b) by omitting from, sub-regulation (2.) the words “member of the Naval Board responsible for naval shipbuilding” and inserting in their stead the words “Director of Shipbuilding”.

Meetings of the Board.

3. Regulation 10 of the National Security (Shipbuilding) Regulations is amended—

(a)by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

“(3.) At any meeting of the Board—

(a) if the Board consists of five members three members shall form a quorum; or

(b) if the Board consists of six members, four members shall form a quorum.”; and

(b)by omitting sub-regulation (5.) and inserting in its stead the following sub-regulation:—

“(5.) The Chairman, or, in his absence, the Director of Shipbuilding, shall preside at all meetings of the Board. In the event of the absence of both the Chairman and the Director of Shipbuilding from any meeting of the Board, the members present shall appoint one of their number to preside at that meeting.”.

4. Regulation 11 of the National Security (Shipbuilding) Regulations is amended by omitting sub-regulations (1.) and (2.) and inserting in their stead the following sub-regulations:—

“(1.) There shall be a Director of Shipbuilding, who shall be appointed by the Minister and shall hold office on such terms and conditions as the Minister determines.

“(2.) There shall be a Deputy Director of Shipbuilding, who shall be the person appointed under regulation 9 of these Regulations to be the deputy of the Director of Shipbuilding.”.

“(2a.) The first Director of Shipbuilding appointed under this regulation shall be deemed to have held office on and from the twenty-fifth day of September, 1943.”.
