REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

National Security (Shearing of Sheep) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Shearing of Sheep) Regulations.

Administration.

2. These Regulations shall be administered by the Minister of State for Labour and National Service.

Definitions.

3. In these Regulations, unless the contrary intention appears—

“flock sheep” means all sheep except—

(a) rams;

(b) ewes from which rams are bred for sale or station use; and

(c) the progeny of such ewes which have not been culled into the general flock;

“the Director-General” means the Director-General of Man Power holding office under the National Security (Man Power) Regulations;

“the Schedule” means the Schedule to these Regulations.

Limitations on shearing of sheep.

4.—(1.) Subject to these Regulations, a person shall not, except after obtaining a permit from the Director-General, or from a person authorized by him—

(a) seek to engage, engage, or cause to be engaged, a person to shear flock sheep;

(b) offer or undertake to shear flock sheep; or

(c) make an agreement for the shearing of flock sheep,

except on condition that the shearing of any flock of flock sheep which is, at the time when the sheep are to be shorn, depastured in an area the whole or part of which is comprised in an area described in the first column of the table in the Schedule shall be undertaken and completed during the prescribed period or cause or permit any such flock of flock sheep to be shorn except during that period.

(2.) In this regulation, “the prescribed period” means—

(a) in the case of a flock of flock sheep depastured at the time when the sheep are to be shorn in an area the whole of which is comprised in any area described in the first column of the table in the Schedule—the period specified in the second column of that table opposite to the description of that area; and

(b) in the case of a flock of flock sheep depastured at the time when the sheep are to be shorn in an area which is in part comprised in an area described in the first column of the table in the Schedule—the period specified in the second column of that table opposite to the description of the area in which is situated the shearing shed or other place at which the sheep are to be shorn.

Regulations not to apply to certain sheep.

5. Nothing in these Regulations shall apply in relation to any sheep where the total number of sheep owned by the owner of the sheep does not exceed one thousand.

All those parts of the State of New South Wales comprised in the Municipalities of Goulburn, Yass, Queanbeyan, Cooma and Bombala, and in the Shires of Lyndhurst, Abercrombie, Oberon, Crookwell, Mulwaree, Gunning, Goodradigbee, Yarrowlumla, Tallaganda, Monaro, Snowy River and Bibbenluke. And also the whole of the Australian Capital Territory
