REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1943.*

I,THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1943.

Amendments of the National Security (Shearing of Sheep) Regulations.

Definitions.

1. Regulation 3 of the National Security (Shearing of Sheep) Regulations is amended—

(a) by adding at the end of paragraph (b)of the definition of “flock sheep” the word “and”;

(b) by omitting from paragraph (c) of that definition the word “and”; and

(c) by omitting paragraph (d) of that definition.

Limitations on shearing of sheep.

2. Regulation 4 of the National Security (Shearing of Sheep) Regulations is repealed and the following regulation inserted in its stead:—

“4.—(1.) Subject to these Regulations, a person shall not—

(a) seek to engage, engage or cause to be engaged, a person to shear flock sheep;

(b) offer or undertake to sheer flock sheep; or

(c) make an agreement for the shearing of flock sheep,

except on condition that the shearing of any flock of flock sheep which is, at the time when the sheep are to be shorn, depastured in an area the whole or part of which is comprised in an area described in the first column of the table in the Schedule, shall be undertaken and completed during the prescribed period, or cause or permit any such flock of flock sheep to be shorn except during that period.

“(2.) In this regulation, ‘the prescribed period’ means—

(a) in the case of a flock of flock sheep depastured at the time when the sheep are to be shorn in an area the whole of which is comprised in any area described in the first column of the table in the Schedule—the period specified in the second column of that table opposite to the description of that area; and

(b)in the case of a flock of flock sheep depastured at the time when the sheep are to be shorn in an area which is in part comprised in an area described in the first column of the table in the Schedule—the period specified in the second column of that table opposite to the description of the area in which is situated the shearing shed or other place at which the sheep are to be shorn.

“(3.) The Director-General may, by writing under his hand exempt any person, or the persons included in any class or description of persons, from compliance with this regulation.

“(4.) Any exemption under the last preceding sub-regulation may be absolute or subject to such conditions as the Director-General thinks fit.

“(5.) Where any such exemption is subject to conditions, a person shall comply with all such conditions as are applicable to him.”.

3. Regulation 5 of the National Security (Shearing of Sheep) Regulations is repealed and the following regulation inserted in its stead:—

Delegation.

“5.—(1.) The Director-General may, by writing under his hand, delegate all or any of his powers and functions under these Regulations (except this power of delegation) so that the delegated powers and functions may be exercised by the delegate.

“(2.) Every delegation under this regulation shall be revocable at will and no delegation shall prevent the exercise of any power or function by the Director-General.”.

The Schedule.

4. The Schedule to the National Security (Shearing of Sheep) Regulations is amended—

(a) by omitting paragraphs 12 and 13 and inserting in their stead the following paragraphs:—

“12. All those parts of the State of Victoria within the following boundaries:—Commencing on the South Australian border at the north-western angle of the Shire of Kowree, thence easterly by the northern boundaries of the Shires of Kowree and Arapiles to the Wimmera River, thence southerly by the Wimmera River to the northern boundary of the Parish of Darragan, thence easterly and southerly by the northern and eastern boundaries of the Parish of Darragan, easterly by the southern boundaries of the Parishes of Bungalally and Drung-Drung, southerly and easterly by the western and southern boundaries of the Parish of Golton-Golton and southerly and easterly by the western and southern boundaries of the Parish of Ledcourt to the eastern boundary of the Parish of Boroka, thence southerly by that boundary to the northern boundary of the Parish of Bellellen, thence easterly by the northern boundaries of the Parishes of Bellellen, Mokepilly, Concongella and Bulgana and southerly by the western boundary of the Parish of Crowlands to the southern boundary of the Shire of Stawell, thence generally easterly by the southern boundaries

of the Shires of Stawell, Avoca, Tullaroop, Newstead Mt. Alexander, Metcalfe, McIvor, Goulburn and Euroa to the eastern boundary of the Shire of Alexandra, thence south-easterly by that boundary to the Mansfield-Tallarook railway line, thence south-westerly by that railway line to the Goulburn River, thence easterly and southerly by the Goulburn and Acheron Rivers to the Marysville-Healesville-road, thence south-westerly by that road to Glenfern-road, township of Healesville, thence northerly by Glenfern-road to the Healesville railway station, thence south-westerly by the Healesville-Melbourne railway line to Melbourne, thence generally south-westerly by the Yarra River, the western shore of Port Phillip Bay and the Victorian coastline to the northern boundary of the Parish of Jan-Juc, thence westerly by the northern boundaries of the Parishes of Jan-Juc, Wormbete and Yan-Yan-Gurt to the Barwon River, thence south-westerly by the Barwon River to the northern boundary of the Parish of Yeo, thence generally westerly by the northern boundaries of the Parishes of Yeo, Elliminyt and Pirron Yaloak to the Pirron Yaloak Creek, thence northerly by the Pirron Yaloak Creek and the western shore of Lake Corangamite to the northern boundary of the Parish of Purrumbete North, thence westerly by the northern boundaries of the Parishes of Purrumbete North, Colongulae and Marida-Yallock to Mount Emu Creek, thence northerly by the Mount Emu Creek to the northern boundary of the Parish of Glenormiston, thence westerly by the northern boundaries of the Parishes of Glenormiston, Kolora and Ellerslie to the Hopkins River, thence north-easterly by the Hopkins River to Muston’s Creek, thence westerly and north-westerly by Muston’s Creek to the northern boundary of the Parish of Quamby North, thence westerly by the northern boundaries of the Parishes of Quamby North and Minjah North and northerly by the western boundary of the Parish of Caramut South to the northern boundary of the Parish of Langulac, thence westerly by the northern boundaries of the Parishes of Langulac and Tallangoork to the Eumeralla River, thence northerly by the Eumeralla River to the northern boundary of the Parish of Napier, thence westerly by the northern boundaries of the Parishes of Napier, Byaduk and Byambynee and northerly by the western boundary of the Parish of Audley to the northern boundary of the Parish of Branxholme, thence westerly by the northern boundaries of the Parishes of Branxholme, Bramburra and Winyayung and northerly by the western boundary of the Parish of Grassdale to the northern boundary of the Parish of Digby, thence westerly by the northern boundaries of the Parishes of Digby and Weecurra and southerly by the eastern boundary of the Parish of Killara to the northern boundary of the Parish of Myaring, thence westerly by that boundary to the Glenelg River, thence northerly by the Glenelg River to the northern boundaries of the Parishes of Werrikoo and Ardno to the South Australian border, and thence north by the South Australian border to the point of commencement

13. All those parts of the State of Victoria within the following boundaries:—Commencing on the South Australian border at the north-western angle of the Parish of Ardno, thence easterly by the northern boundaries of the Parishes of Ardno and Werrikoo to the Glenelg River, thence southerly by the Glenelg River to the northern boundary of the Parish of Myaring, thence easterly by that boundary and northerly by the eastern boundary of the Parish of Killara to the northern boundary of the Parish of Weecurra, thence easterly by the northern boundaries of the Parishes of Weecurra and Digby and southerly by the western boundary of the Parish of Grassdale to the northern boundary of the Parish of Winyayung, thence easterly by the northern boundaries of the Parishes of Winyayung, Bramburra and Branxholme and southerly by the western boundary of the Parish of Audley to the northern boundary of the Parish of Byambynee, thence easterly by the northern boundaries of the Parishes of

8th November to 30th June (both inclusive)

(b)by omitting paragraphs 17, 18, 19 and 20 therein and inserting in their stead the following paragraphs:—

by the western boundary of the Hundred of Tomkinson, County of Burra southerly, part of the northern boundary of the Hundred of Mongolata westerly, the western boundaries of the Hundreds of Mongolata, Baldina and Bright, County of Burra southerly, by the southern boundary of the County of Burra easterly, part of the western boundary of the County of Young southerly to the River Murray and thence by that river upwards to its intersection with the eastern boundary of the State of South Australia

“18. That portion of the State of South Australia south of the southern boundary of the areas described in paragraphs 16 and 17 of this Schedule and north of the Cowell and Elliston Main Road extending from Elliston to the eastern boundary of the Hundred of Rudall, County of Jervois, and north-east of the sea coast extending from Ceduna to Elliston

“18a. That portion of the State of South Australia, south of the southern boundary of the areas described in paragraphs 17 and 18 of this Schedule and north of a line commencing at Elliston and following the sea coast south-easterly and north-easterly to the intersection of the eastern boundary of the Hundred of Boothby, County of Jervois, with the western shore of Spencer Gulf

1st December to 25th October (both inclusive)

“19. That portion of the State of South Australia south of the southern boundary of the area described in paragraph 17 of this Schedule and north of a line commencing on the eastern shore of Spencer Gulf at Port Augusta, following the sea coast along the eastern shore of Spencer Gulf and Yorke Peninsula and then to Port Adelaide, easterly from Port Adelaide along the Railway line to Dry Creek, thence following the railway line through Gawler and Nuriootpa to its intersection with the western boundary of the Hundred of Jellicoe, County of Eyre, by latter boundary south-easterly to the western corner of Section 169 by the western boundaries of Sections 169 and 171, northerly by the road north of Sections 171, 72, 747 and 27, easterly to the eastern boundary of Hundred of Jellicoe aforesaid, and by its eastern and southern boundaries south and west, to the south-western corner thereof, thence in a direct line to Mannum, following the River Murray to Tailem Bend, thence along the railway line to its intersection with the northern boundary of the Hundred of Stirling, County of Buckingham, by the northern boundaries of the Hundreds of Stirling and Senior easterly to the eastern boundary of the State of South Australia, exclusive of the area described in paragraph 19a of this Schedule
