REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

National Security (Regulations Revision) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Regulations Revision) Regulations.

Administration.

2. These Regulations shall be administered by the Attorney-General.

Amendment of the Aircraft Production Regulations.

3. Regulation 11 of the National Security (Aircraft Production) Regulations is amended by inserting in paragraph (e)of sub-regulation (1.) of regulation 11, after the word “Havilland”, the word “Aircraft”.

Amendment of the Aliens Service Regulations.

4. The National Security (Aliens Service) Regulations are amended by omitting from sub-regulation (1a.) of regulation 8 the word “which” (first occurring) and inserting in its stead the word “whom”.

Amendments of the Army Inventions Regulations.

5. The National Security (Army Inventions) Regulations are amended—

(a) by omitting from sub-regulation (4.) of regulation 5 the word “deliberate” and inserting in its stead the word “deliberative”;

(b) by omitting from regulation 7 the word “their” and inserting in its stead the word “his”; and

(c) by inserting in sub-regulation (1.) of regulation 11, after the word “as” (second occurring) the word “are”.

Repeal of Australian Industrial Relations Council Regulations.

6. The National Security (Australian Industrial Relations Council) Regulations (being Statutory Rules 1942, No. 1, as amended by Statutory Rules 1942, No. 18) are repealed.

Amendment of the Australian Tobacco Leaf Regulations.

7. Regulation 12 of the National Security (Australian Tobacco Leaf) Regulations is amended by omitting from sub-regulation (3.) the figures “1922” and inserting in their stead the figures “1928”.

Amendments of the Cargo Control Regulations.

8. The National Security (Cargo Control) Regulations are amended—

(a) by omitting from paragraph (d)of sub-regulation (1.) of regulation 15 the word “the” (third occurring); and

(b) by omitting from sub-regulation (3.) of regulation 21 the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendments of the Cash Orders and Hire Purchase Agreements Regulations.

9. The National Security (Cash Orders and Hire Purchase Agreements) Regulations are amended—

(a)by omitting from sub-regulation (3.) of regulation 19 the words “record, certificate or statutory declaration” and inserting in their stead the words “record or certificate”; and

(b) by omitting sub-regulation (2.) of regulation 24 and inserting in its stead the following sub-regulation:—

“(2.) A person required to keep records under the last preceding sub-regulation shall preserve all records kept accordingly for a period of at least twelve months after the completion of the transaction to which the record relates.”.

Amendments of the Civil Defence Workers’ Compensation Regulations.

10. The National Security (Civil Defence Workers’ Compensation) Regulations are amended—

(a) by omitting from sub-paragraph (iii) of paragraph (a)of regulation 8 the words “a volunteer” and inserting in their stead the words “an eligible person”;

(b) by omitting from regulation 11 the words “a volunteer” and inserting in their stead the words “an eligible person”;

(c) by omitting from paragraph (b)of sub-regulation (2.) of regulation 16 the words “civil defence volunteer” and inserting in their stead the words “eligible person”;

(d) by omitting from the proviso to regulation 25 the word “volunteer” and inserting in its stead the word “person”;

(e) by omitting from sub-regulation (2.) of regulation 29 the words “volunteer, or dependant of a volunteer” and inserting in their stead the words “eligible person, or dependant of an eligible person”;

(f) by omitting from regulation 52 the figure and symbols “(2.)” (second occurring) and inserting in their stead the figure and symbols “(3.)”; and

(g)by omitting from regulation 56 the words “a volunteer” and inserting in their stead the words “an eligible person”.

Amendment of the Coal Control Regulations.

11. The heading to Part III. of the National Security (Coal Control) Regulations is amended by omitting the word “Commissioner” and inserting in its stead the word “Commission”.

 

Amendments of the Contracts Adjustment Regulations.

12. The National Security (Contracts Adjustment) Regulations are amended—

(a) by omitting from paragraph (d)of the definition of “tribunal” in sub-regulation (1.) of regulation 2 the words “that State or Territory” and inserting in their stead the words “the State or Territory in which the property is situated”; and

(b) by omitting from regulation 13 the words “the National Security (Fair Rents) Regulations or”.

Amendments of the Egg Control Regulations.

13. The Egg Control Regulations are amended—

(a)by omitting from regulation 1 the words “Egg Control” and inserting in their stead the words “National Security (Egg Control)”;

(b) by omitting from the Schedule the words “Egg Control” (wherever occurring) and inserting in their stead the words “National Security (Egg Control)”; and

(c) by inserting after the word “Commerce” (wherever occurring) the words “and Agriculture”.

Repeal of Employment of Women Regulations.

14. The National Security (Employment of Women) Regulations (being Statutory Rules 1942, No. 146, as amended by Statutory Rules 1942, Nos. 236, 263, 294, 381 and 393) are repealed.

Amendment of the Enemy Property Regulations.

15. Regulation 3 of the National Security (Enemy Property) Regulations is amended by omitting from sub-regulation (1.) of regulation 3 the figures “14” and inserting in their stead the figures “19”.

Amendments of the Field Peas Acquisition Regulations.

16. The National Security (Field Peas Acquisition) Regulations are amended—

(a) by adding at the end of regulation 2 the words “and Agriculture.”; and

(b) by omitting from sub-regulation (3.) of regulation 10 the figures “1922” and inserting in their stead the figures “1928”.

Amendments of the General Regulations.

17. The National Security (General) Regulations are amended—

(a) by omitting sub-regulation (2.) of regulation 27;

(b) by omitting from sub-regulation (1.) of regulation 35a the words “Commandant of a Military District or an officer authorized by the Minister for Defence Co-ordination or the Minister of State for the Army to act on behalf of such Commandant” and inserting in their stead the words “Commander of a Lines of Communication Area or an officer authorized by the Minister of State for the Army to act on behalf of such a Commander”;

(c) by omitting regulation 39; and

(d) by inserting in paragraph (a)of regulation 62, after the word “as”, the word “are”.

Amendment of the Interstate Shipments of Coal by Overseas Ships Regulations.

18. The National Security (Interstate Shipments of Coal by Overseas Ships) Regulations are amended by omitting from sub-regulation (2.) of regulation 4 the words “Minister of State for Commerce” and inserting in their stead the words “Minister of State for Supply and Shipping”.

Amendments of the Land Transport Regulations.

19. The National Security (Land Transport) Regulations are amended—

(a) by inserting in regulation 2, after the figures “278”, the words “, as amended by Statutory Rules 1942, No. 31”;

(b) by inserting in that regulation, after the figures “279”, the words “, as amended by Statutory Rules 1942, No. 32”; and

(c) by omitting from sub-regulation (3.) of regulation 21 the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendments of the Man Power Regulations.

20. The National Security (Man Power) Regulations are amended—

(a) by omitting from sub-regulation (2.) of regulation 11 the (figures “1922” (wherever occurring) and inserting in their stead the figures “1928”;

(b) by omitting from that sub-regulation the word “a” (first occurring); and

(c) by omitting from regulation 43 the figure and symbols “—(1.)”.

Amendment of the Marine War Risks Insurance Regulations.

21. The National Security (Marine War Risks Insurance) Regulations are amended by omitting from sub-regulation (3.) of regulation 8 the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendment of the Meat Industry Regulations.

22. The National Security (Meat Industry) Regulations are amended by omitting from sub-regulation (3.) of regulation 11 the figures “1922” and inserting in their stead the figures “1928”.

Amendment of the Minerals Regulations.

23. Regulation 6 of the National Security (Minerals) Regulations is amended by inserting in paragraph (c) of sub-regulation (2.), after the word “supply”, the word “of”.

Amendment of the Naval Charter Rates Regulations.

24. The National Security (Naval Charter Rates) Regulations are amended by omitting from regulation 10 all the words before the words “in respect of” and inserting in their stead the words—

“10. After the commencement of these Regulations no action shall be brought”.

Amendment of the Prisoners of War Regulations.

25. The National Security (Prisoners of War) Regulations are amended by omitting from sub-regulation (3.) of regulation 42 the word “Order” and inserting in its stead the word “Orders”.

Amendment of the Rationing Regulations.

26. The National Security (Rationing) Regulations are amended by omitting from sub-regulation (3.) of regulation 13 the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendment of the Shipping Control Regulations.

27. The National Security (Shipping Control) Regulations are amended by omitting from sub-regulation (2.) of regulation 23 the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendment of the Shipping Requisition Regulations.

28. The National Security (Shipping Requisition) Regulations are amended by omitting from sub-paragraphs (4.) and (8.) of paragraph 27 of the Standard Time Charter Party set out in the Schedule to those Regulations the words “Minister of State for Commerce” (wherever occurring) and inserting in their stead the words “Minister of State for Supply and Shipping”.

Amendment of the Staff of War-time Authorities Regulations.

29. The National Security (Staff of War-time Authorities) Regulations are amended—

(a) by omitting from the Second Schedule the words “Superphosphate Industry Commission” and inserting in their stead the words “Superphosphate Industry Committee”; and

(b) by omitting from the Twelfth Schedule the words “Superphosphate Industry Commission” and inserting in their stead the words “Superphosphate Industry Committee”.

Amendment of the Stevedoring Industry Regulations.

30. Regulation 9a of the National Security (Stevedoring Industry) Regulations is amended by omitting from sub-regulation (3.) the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendments of the Supplementary Regulations.

31. The National Security (Supplementary) Regulations are amended—

(a) by omitting regulations 19 and 20;

(b) by omitting from regulation 22 the words “last three preceding regulations” and inserting in their stead the words “last preceding regulation”;

(c) by omitting from regulation 23 the word “four” and inserting in its stead the word “two”;

(d) by omitting from regulation 23 the definition of “the Secretary”;

(e) by omitting regulation 54; and

(f) by omitting regulation 68.

Amendments of the Stock Dispersal Regulations.

32.—(1.) The National Security (Stock Dispersal) Regulations are amended—

(a) by omitting from sub-regulation (3.) of regulation 13 the figures “1922” and inserting in their stead the figures “1928”; and

(b) by adding at the end of regulation 17a the following sub-regulation:—

“(2.) Any moneys paid by the Committee to the owner or occupier of any land in pursuance of any such guarantee shall be recoverable by the Committee from the owner of the stock and shall constitute a first charge on the stock.”.

(2.) Sub-regulation (2.) of regulation 4 of Statutory Rules 1942, No. 310, is repealed.

(3.) This regulation shall be deemed to have come into operation on the 15th day of July, 1942.

Amendment of the Tea Control Regulations.

33. Regulation 10a of the National Security (Tea Control) Regulations is amended by omitting from sub-regulation (3.) the figures “1922” (wherever occurring) and inserting in their stead the figures “1928”.

Amendment of the War Damage to Property Regulations.

34. The National Security (War Damage to Property) Regulations are amended by omitting from paragraph (b) of sub-regulation (1.) of regulation 38 the word “to” (second occurring).

Amendment of the War Injuries Compensation Regulations.

35. Regulation 60 of the National Security (War Injuries Compensation) Regulations is amended by omitting the words “a civil defence volunteer” and inserting in their stead the words “an eligible person”.

Amendment of the War Pensions and Repatriation Benefits Regulations.

36. Regulation 9 of the National Security (War Pensions and Repatriation Benefits) Regulations is amended by inserting in sub-regulation (1.) of regulation 9, after the word “wife” (first occurring), the word “, children”.

Amendments of the War Service Moratorium Regulations.

37. The National Security (War Service Moratorium) Regulations are amended—

(a) by omitting from sub-regulation (2.) of regulation 25 the word “its” and inserting in its stead the word “their”;

(b) by omitting from sub-regulation (5.) of regulation 30 the words “for a period of” and inserting in their stead the words “in respect of a period of not less than”; and

(c) by omitting from sub-regulation (4.) of regulation 30 the words “in pursuance of sub-regulation (1.) of this regulation” and inserting in their stead the words “to a tenant who is a member of the Forces, a parent of a member or a female dependant of a member”.

Amendment of the Wheat Harvest Employment Regulations.

38. Regulation 3 of the National Security (Wheat Harvest Employment) Regulations is amended by omitting the words “sown during the year 1942” (second occurring).

Amendment of the Wool Regulations.

39. Regulation 24 of the National Security (Wool) Regulations is repealed.

Repeal of the Woollen Contracts Avoidance Regulations.

40. The Woollen Contracts Avoidance Regulations (Statutory Rules 1939, No. 109) are repealed.

Amendment of Statutory Rules 1942, No. 281.

41. Statutory Rules 1942, No. 281 is amended by omitting from regulation 2 the word “Schedule” and inserting in its stead the word “Schedules”.

Amendment of Statutory Rules 1942, No. 419.

42. Regulation 4 of Statutory Rules 1942, No. 419, is amended by omitting from paragraph (b)the word “race-meeting” and inserting in its stead the word “race-meetings”.

Amendment of Statutory Rules 1942, No. 456.

43. Regulation 3 of Statutory Rules 1942, No. 456, is amended by omitting the word “or” (first occurring).

Amendment of Statutory Rules 1943, No. 5.

44. Regulation 3 of Statutory Rules 1943, No. 5, is amended by inserting after the word “subject” the words “(first occurring)”.
