REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1943.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1943.

Amendments of the National Security (Rationing) Regulations. 

1. Regulation 23 of the National Security (Rationing) Regulations is repealed and the following regulation inserted in its stead:—

Preventing or obstructing entry, search, &c.

“23. A person shall not—

(a) prevent or attempt to prevent the Director, a Deputy Director or an authorized officer from exercising any power under the last preceding regulation, or obstruct or attempt to obstruct any such exercise; or

(b) refuse to produce any article in his possession or to give any assistance or information which he is reasonably required to produce or give by the Director, a Deputy Director or an authorized officer for the purpose of enabling him effectively to exercise any such power.”.

2. Regulation 25 of the National Security (Rationing) Regulations is amended by inserting in sub-regulation (1.), after the word “Regulations” (first occurring), the words “(other than regulation 34 of those Regulations)”.

3. Regulation 27 of the National Security (Rationing) Regulations is amended by inserting in sub-regulation (3.), after the word “shall”, the words “, if the notice so requires,”.

4. After regulation 27 of the National Security (Rationing) Regulations the following regulation is inserted:—

Director or Deputy Director may require scales to be installed at abattoirs.

“27a.—(1.) The Director, a Deputy Director or any authorized officer may, by notice in writing, direct the proprietor or person in charge of any establishment at which animals are killed from the carcasses of which rationed goods are obtained to provide or install at that establishment, within the time specified in the notice, scales, weighing machines or other weighing devices of the kind and number specified in the notice, being scales, machines or devices which the person giving the direction considers necessary to enable such carcasses and goods to be properly weighed.

“(2.) In any prosecution in respect of a refusal or failure to comply with a direction given under this regulation, it shall be a defence for the person charged to prove that he made all reasonable endeavours to comply with the direction.

“(3.) If a person to whom a direction is given under this regulation fails to comply with the direction within the time specified in the notice, he shall, unless the direction is revoked, comply with the requirements of the direction as soon after the expiration of that time as is practicable.”.

5. After regulation 28b of the National Security (Rationing) Regulations the following regulation is inserted:—

Return of lost ration documents.

“28ba. Where a ration document has been issued to a person in place of a ration document reported to have been lost or destroyed, that person shall, if he subsequently finds, or obtains possession or custody of, the document reported to have been lost or destroyed, forthwith return the last-mentioned document to the Commission.”.

6. After regulation 37 of the National Security (Rationing) Regulations the following Regulation is inserted:—

Authority to supply and obtain goods.

“38. Where, in pursuance of these Regulations or of any order made thereunder, authority is given to supply any rationed goods otherwise than in accordance with the provisions of any Order made under these Regulations which would otherwise apply to that supply, that authority shall, unless the contrary intention appears, operate to authorize any person to obtain those goods when supplied in accordance with that authority.”.
