1942. No. 301

REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

Amendments of National Security (Potatoes) Regulations.

1. After regulation 9 of the National Security (Potatoes) Regulations the following regulation is inserted:—

Advisory Committees.

“9a.—(1.) For the purposes of these Regulations there shall be an Advisory Committee appointed for each State which shall consist of such persons as are appointed by the Minister by notice published in the Gazette and who shall hold office during the pleasure of the Minister.

“(2.) The Minister may appoint one member of each Committee to be the Chairman of that Committee.

“(3.) The quorum of any Committee shall be such number of members as the Minister from time to time directs.

“(4.) At any meeting of a Committee, the Chairman shall have a deliberative vote and, in the event of an equality of voting, shall also have a casting vote.

“(5.) All questions before a Committee shall be decided by a majority of votes.

“(6.) Any member of the Australian Potato Committee shall have the right to attend and take part in the proceedings of any meeting of a Committee but, unless be is a member of that Committee, shall not vote or be counted in any quorum.”.

Fees and expenses.

2. Regulation 10 of the National Security (Potatoes) Regulations is amended by inserting, after the word “Committee”, the words “or an Advisory Committee”.

Appointment of officers.

3. Regulation 11 of the National Security (Potatoes) Regulations is amended by inserting in sub-regulation (1.), after the word “Committee” (second occurring), the words “or an Advisory Committee”.

4. After regulation 14 of the National Security (Potatoes) Regulations the following regulations are inserted:—

Registration of wholesale potato merchants.

“14a.—(1.) A person shall not carry on business as a wholesale potato merchant unless within seven days after the commencement of this regulation or before the date on which he commences to carry on such business, he becomes registered as a wholesale potato merchant under these Regulations.

“(2.) Every person desiring to be so registered shall make application in such form and furnish such information as the Committee requires.

“(3.) The Committee may, in its absolute discretion, register any person as a wholesale potato merchant and may, at any time, for reasons which it thinks fit, cancel the registration of any registered wholesale potato merchant.

Returns.

“14b. The Committee may, by notice in writing addressed to any person, or by notice published in the Gazette specifying any class of persons, require that person or class of persons to furnish returns containing such information relating to potatoes as is specified in the notice, and that person, or every person of that class, as the case may be, shall, within the time and in the manner specified in the notice, furnish a return accordingly.

False returns or information.

“14c. A person shall not furnish any return or information, pursuant to a requirement under these Regulations, or any order thereunder, which is false or misleading in any particular.”.

Finance.

5. Regulation 17 of the National Security (Potatoes) Regulations is amended by omitting the word “Board” and inserting in its stead the word “Committee”.
