REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I,THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

National Security (Post Office Volunteer Corps) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Post Office Volunteer Corps) Regulations.

Definitions.

2. In these Regulations, unless the contrary intention appears—

“employee” means any male person permanently or temporarily employed in the Postmaster-General’s Department;

“member” means any person who is enrolled in the Corps;

“prescribed” means prescribed by these Regulations or by orders made thereunder;

“the Corps” means the Post Office Volunteer Corps;

“the Minister” means the Minister of State for the Commonwealth charged with the administration of the Post and Telegraph Act 1901-1934.

Formation of Corps.

3. The Minister may form and organize an armed volunteer force, to be called the Post Office Volunteer Corps, the purpose of which shall be to safeguard the services and property which is wholly or in part under the control of, or operated by, the Postmaster-General’s Department, and the members of which shall be employees of the said Department, or other persons approved by the Minister, who are enrolled in the Corps.

The Minister may issue orders.

4. The Minister may by order make provision for or in relation to the establishment, maintenance and operation of the Corps.

Enrolment in Corps.

5. Each person who desires to apply for enrolment in the Corps shall complete and sign a form of application in accordance with the form in the Schedule to these Regulations, and any such person whose application is accepted in writing as prescribed shall become a member of the Post Office Volunteer Corps.

Indemnification of members.

6. The Minister may indemnify any employee in respect of any loss sustained, or damage incurred, by the employee in the course of his duty as a member of the Corps.

Injuries to members.

7. Compensation may be paid to a member in respect of any personal injury to, or accident sustained by, him arising out of and in the course of his duty as a member of the Corps in like manner as compensation is payable in respect of any injury or accident arising out of and in the course of his normal employment.

Obligations of members.

8. Any obligations imposed on a member shall have effect only with regard to his service in the capacity of a member and shall leave unaffected his rights and liabilities under the Commonwealth Public Service Act 1922-1939 or any other law governing his employment.

Powers of members.

9.—(1.) A member shall have the power to restrain or prevent any person from wilfully and unlawfully destroying or damaging or from forcibly entering, or from trespassing upon, land, buildings and plant, which are wholly or in part under the control of or operated by the Postmaster-General’s Department, and may use such force as is necessary to prevent any such act.

(2.) A member may detain a person committing any such act until the services of a constable or other constituted authorities are obtained.

Suspension or termination of services.

10. The Minister may at any time suspend or terminate the services of any member of the Corps and may revoke any such suspension.

Resignations.

11.—(1.) A member shall continue in the Corps until he has been discharged or his resignation has been accepted.

(2.) Any resignation shall take effect not later than four weeks from the date on which it is received by the Minister.

APPLICATION FOR ENROLMENT.

I,  , hereby apply for enrolment as a member of the Post Office Volunteer Corps and agree, if accepted, to conform in every respect to the following obligations:—

(1) To recognize and be loyal to constituted authority;

(2) To carry out all duties allotted to me to the best of my ability;

(3) To undergo such training as may be prescribed; and

(4) To report immediately as and when called upon.
