REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

Amendments of the National Security (Man Power) Regulations.

1. Regulation 21 of the National Security (Man Power) Regulations is amended—

Definitions.

(а) by omitting paragraph (a) of the definition of “registration return” and inserting in its stead the following paragraph:—

“(a) a form in accordance with Form 1, Form 2, Form 6 or Form 7 transmitted, or required to be transmitted, to a Returning Officer under these Regulations; and”; and

(b) by omitting the definition of “the registration”.

Application of Part to additional classes of persons.

2. Regulation 22 of the National Security (Man Power) Regulations is repealed.

3. Regulation 24 of the National Security (Man Power) Regulations is repealed and the following regulation inserted in its stead:—

Obligation to register.

“24.—(1.) Subject to this Part, every person in the Commonwealth (not being a registered person) who has attained, or will attain, the age of fourteen years on or before the twenty-second day of

April, 1943, shall, on or before that date, and every person who attains that age after that date shall, within ten days after attaining that age—

(a) obtain, or cause to be obtained, a form in accordance with Form 6 or Form 7, whichever is applicable;

(b) fill in and supply in the form, in accordance with the instructions contained therein, all the particulars specified therein;

(c) sign his name to the form; and

(d) transmit the form, in accordance with the instructions contained therein, to the Returning Officer for the Electoral Division in which the person to whom the form relates resides.

“(2.) Where any person to whom the last preceding sub-regulation applies is an incapable person, he shall not he required to comply with the provisions of that sub-regulation, but the person who is, on the twenty-second day of April, 1943, or on the day on which the first-mentioned person attains the age of fourteen years, as the case may be, for the purposes of this Part, deemed to be in charge of that incapable person shall, in respect of the incapable person, comply with those provisions, and in addition shall state under his signature the reason why the incapable person is unable to sign personally.”.

Part III. not to apply to certain persons.

4. Regulation 26 of the National Security (Man Power) Regulations is amended—

(a) by omitting the words “twenty-fifth day of March, 1942” and inserting in their stead the words “twenty-second day of April, 1943” and

(b) by omitting sub-paragraph (iii) of paragraph (e) and inserting in its stead the following sub-paragraph:—

“(iii) The Royal Australian Naval Nursing Service;”.

Mistaken compliance to be notified.

5. Regulation 27 of the National Security (Man Power) Regulations is repealed.

6. Regulation 28 of the National Security (Man Power) Regulations is repealed and the following regulations inserted in its stead:—

Registration after 22nd April, 1943.

“28.—(1.) Subject to this regulation, every person who fails to comply with the provisions of regulation 24 of these Regulations shall, forthwith after becoming aware that he has so failed to comply—

(a) obtain, or cause to be obtained, a form in accordance with Form 6 or Form 7 whichever is applicable;

(b) fill in and supply in the form, in accordance with the instructions contained therein, all the particulars specified therein;

(c) sign his name to the form;

(d) sign a statement setting out the reason why regulation 24 of these Regulations was not complied with; and

(e) transmit the form, in accordance with the instructions contained therein, together with the statement referred to in the last preceding paragraph attached, to the Returning Officer for the Electoral Division in which the person to whom the form relates resides.

 

“(2.) Subject to this regulation, a person who—

(a) failed to comply with the provisions of regulation 24 of these Regulations, as in force immediately prior to the commencement of this sub-regulation;

(b) having attained the age of fourteen years on or before the twenty-second day of April, 1943, enters the Commonwealth, after that date, and is not a registered person whose identity card was not previously surrendered under regulation 40 of these Regulations, or a person described in any of the paragraphs (a) to (e) (inclusive) of regulation 26 of these Regulations; or

(c) ceases, after the twenty-second day of April, 1943, to be a person described in any of those paragraphs without becoming, or continuing to be, a person described in any other of those paragraphs,

shall, in the case of a person to whom paragraph (a) of this sub-regulation applies, forthwith after becoming aware that he has failed to comply with the provisions of regulation 24 of these Regulations, as in force immediately prior to the commencement of this sub-regulation and, in any other case, within seven days after the happening of the event specified in paragraph (b) or (c) of this sub-regulation, whichever is applicable—

(d) obtain, or cause to be obtained, a form in accordance with Form 1 or Form 2, whichever is applicable;

(e) fill in and supply in the form, in accordance with the instructions contained therein, all the particulars specified therein;

(f) sign his name to the form;

(g) sign a statement setting out—

(i) in the case of a person to whom paragraph (a) of this sub-regulation applies—the reason why regulation 24 of these Regulations, as in force immediately prior to the commencement of this sub-regulation, was not complied with;

(ii) in any other case—the reason why regulation 24 of these Regulations was not applicable to him;

(h) transmit the form, in accordance with the instructions contained therein, together with the statement referred to in the last preceding paragraph attached, to the Returning Officer in the Electoral Division in which the person to whom the form relates resides.

“(3.) Where any person to whom sub-regulation (1.) or sub-regulation (2.) of this regulation applies is an incapable person, he shall not be required to comply with the provisions thereof, but the person who is, at the date when the incapable person would, but for this sub-regulation, have been required to comply with sub-regulation (1.) or sub-regulation (2.) of this regulation, deemed to be in charge of the incapable person, shall, in respect of the incapable person, comply with those provisions, and in addition shall state under his signature on the form the reason why the incapable person is unable to sign personally.”.

7. Regulation 34 of the National Security (Man Power) Regulations is repealed.

Registrars-General to furnish particulars of deaths and marriages.

8. Regulation 53 of the National Security (Man Power) Regulations is amended by omitting from paragraphs (a) and (b) of sub-regulation (1.) the words “fifteenth day of March, 1942, had attained the age of 16 years” and inserting in their stead the words “twenty-second day of April, 1943, had attained the age of fourteen years or attained that age after that date”.

Envelopes and forms.

9. Regulation 56 of the National Security (Man Power) Regulations is amended by omitting from sub-regulation (2.) the word and figure “and 2” and inserting in their stead the word and figures “, 2, 6 and 7”.

Amendment of First Schedule.

10. The First Schedule to the National Security (Man Power) Regulations is amended by adding at the end thereof the following Forms:—

1. This application must, in accordance with the National Security (Man Power) Regulations, be filled in by Youths who are British Subjects, who turn 14 or are over that age but were under 16 as at 15th March, 1942. There is a special card for girls. No application is required from children under 14. Non-British Subjects must not fill in this form.

2. Complete, sign and post this form to the Divisional Returning Officer for the Commonwealth Electoral Division in which you reside before the 22nd April, 1943, or, if you turn 14 after that date, forthwith after attaining that age.

3. Use Ink, write clearly and check your answers.

4. Occupation.—(a) State the full name of your occupation exactly, e.g., use terms such as “clerk,” “messenger boy,” “postal assistant.” “builders’ labourer,” “metal machinist,” “coal miner.” Do not use general terms such as “civil servant,” “miner,” “labourer,” “factory worker” unless you indicate the actual nature of the work you do.

(b) Where applicable add the word “apprentice” or “trainee.”

(c) If you have left school and are not working, write “unemployed” unless you are a full-time student at a University or Technical College (in which case, state that fact).

5. Your usual personal signature is necessary as it will be used as a specimen signature.

6. One of your parents or your guardian must countersign the form.

7. If your application is in order, your Civilian Identity Card will be posted to you within a few weeks.

INSTRUCTIONS (Form C.R. 6).

1. This application must, in accordance with the National Security (Man Power) Regulations, be filled in by Girls who turn 14 and are over that age but were under 16 on 15th March, 1942, who are British Subjects. There is a special card for youths. No application is required from children under 14. Non-British Subjects must not fill in this form.

2. Complete, sign and post this form to the Divisional Returning Officer for the Commonwealth Electoral Division in which you reside before the 22nd April, 1943, or, if you turn 14 after that date, forthwith after attaining that age.

3. Use ink, write clearly and check your answers.

4. The address you give must be your usual place of living and be full and exact. Do not give an address C/o Post Office or P.O. Box.

5. Occupation.—(a) State the full name of your occupation exactly as described in awards, &c. Be as specific as possible.

(b) If you have left school and are not working write “Unemployed”, unless—

(i) you are a full-time student at a University or Technical College, in which case, state that fact; or

(ii) you are engaged in home duties, in which case, write “H.D.”

6. Your usual personal signature is necessary as it will be used as a specimen signature.

7. One of your parents or your guardian must countersign the form.

If your application is in order, your Civilian Identity Card will be posted to you within a few weeks.

The form is small to save cardboard: Help by not spoiling cards. Obtain one card only for each person.
