REGULATIONS UNDER THE DEFENCE (TRANSITIONAL PROVISIONS) ACT 1946-1947.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence (Transitional Provisions) Act 1946-1947.

Amendments of the National Security (Liquid Fuel) Regulations. 

Definitions.

1. Regulation 4 of the National Security (Liquid Fuel) Regulations is amended—

(a) by inserting after the definition of “bulk supplier” the following definition :—

“ ‘ Deputy Controller ’ means a Deputy Controller of Liquid Fuel appointed under these Regulations ;”; and

(b) by omitting the definition of “ the Deputy Controller ”.

2. Regulation 10 of the National Security (Liquid Fuel) Regulations is repealed and the following regulation inserted in its stead :—

Controller and Deputy Controller of Liquid Fuel.

“ 10.—(1.) There shall be—

(a) a Controller of Liquid Fuel; and

(b) one or more Deputy Controllers of Liquid Fuel,

who shall be appointed by the Minister on such terms and conditions as the Minister thinks fit and shall hold office during the pleasure of the Minister.

(2.) The person holding the office of Controller of Liquid Fuel immediately prior to the commencement of this regulation shall continue to hold office as if appointed under this regulation.

  Being the Regulations having that title as in force under the Defence (Transitional Provisions) Act 1946-1947 as amended by Statutory Rules 1947, No. 58; and 1948, Nos. 84 and 129. The Regulations under the National Security Act 1939-1946 having the corresponding title comprise Statutory Rules 1940, No. 293, as amended by Statutory Rules 1941, Nos. 118, 147, 186 and 289; 1942, Nos. 70, 260 and 351; 1943, No. 134; and 1944, No. 113.

(3.) Subject to any directions of the Controller, a Deputy Controller may exercise all the powers and functions of the Controller.”.

Authentication of Orders, licences, notices, &c.

3. Regulation 14 of the National Security (Liquid Fuel) Regulations is amended by omitting the words “ the Deputy ” and inserting in their stead the words “ a Deputy ”.

Proof of certificates and signatures in Court proceedings.

4. Regulation 53 of the National Security (Liquid Fuel) Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “ the Deputy ” and inserting in their stead the words “ a Deputy ”;

(b) by omitting from sub-regulation (2.) the word “ Deputy ” and inserting in its stead the words “ a Deputy ”; and

(c) by omitting from sub-regulation (3.) the words “ the Deputy ” (wherever occurring) and inserting in their stead the words “ a Deputy ”.

Proof of resolutions of Board.

5. Regulation 53a of the National Security (Liquid Fuel) Regulations is amended by omitting the words “ the Deputy ” and inserting in their stead the words “ a Deputy ”.

Evidence regarding ration tickets.

6. Regulation 53b of the National Security (Liquid Fuel) Regulations is amended by omitting the words “ the Deputy ” and inserting in their stead the words “ a Deputy ”.
