REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939.

Amendment of National Security (General) Regulations. 

Definitions.

1. Regulation 3 of the National Security (General) Regulations is amended by inserting in sub-regulation (1.), after the definition of “postal article”, the following definition:—

“‘print’ means make or produce a copy or copies by any method of making, duplicating or multiplying copies, and the terms ‘printed’ or ‘printer’ have corresponding meanings;”.

2. After regulation 17 of the National Security (General) Regulations the following regulation is inserted:—

Name of printer, &c., to appear on certain papers.

17a.—(1.) A person shall not, without lawful excuse (proof whereof shall lie upon him)—

(a) print for publication or dispersion any paper;

(b) publish, distribute or circulate any paper printed after the commencement of this regulation; or

(c) have in his possession any paper so printed,

unless there is printed, in legible characters—

(i) in the case of a newspaper—in some convenient part thereof, the name and address of its printer and of its publisher; and

(ii) in the case of any other paper—on the front thereof, if it is printed upon one side only, and upon the first and last leaf thereof, if there are more such leaves than one, the name and address of the printer, and

(1) where the paper is printed on behalf of a person other than the printer, a statement to that effect specifying the name and address of the person on whose behalf the paper is printed; and

(2) where the paper is printed on behalf of a body of persons (corporate or unincorporate), other than the printer, a statement to that effect specifying the name of that body.

“(2.) A person shall not, unless he is the holder of a permit issued by a person thereto authorized by a Minister, or unless he is the employee or agent of the holder of such a permit, distribute or circulate any printed paper, being a pamphlet, ‘dodger’, circular, handbill, card or poster, or any book, periodical or newspaper which has been specified by the Minister by notice published in the Gazette to be a book, periodical or newspaper to which this regulation applies, or cause any such paper to be distributed or circulated.

“(3.) The Minister may, by notice published in the Gazette, specify any book, periodical or newspaper to be a book, periodical or newspaper to which this regulation applies.

“(4.) For the purposes of this regulation—

‘address’, in relation to any person, means the name of the place and of the street or other part thereof (if any) in which the usual place of abode of the person is situated; and

‘paper’ means book, periodical, pamphlet, ‘dodger’, circular, handbill, card, poster or newspaper containing information being, or purporting to be, information with respect to—

(i) the number, description, armament, equipment, disposition, movement or condition of any of the forces, vessels or aircraft of the King or the Commonwealth;

(ii) any operations or projected operations of any of those forces, vessels or aircraft;

(iii) any measures for the defence or fortification of any place on behalf of the King or the Commonwealth;

(iv) the number, description or location of any prisoners of war;

(v) munitions of war;

(vi) any other matter whatsoever information as to which would or might be directly or indirectly useful to an enemy; or

(vii) any matter whatsoever relating to the war or the defence of the Commonwealth,

or containing comment with respect to any of such matters.”.
