REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939–1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939–1940.

National Security (Gas Masks) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Gas Masks) Regulations.

Administration.

2. These Regulations shall be administered by the Minister of State for Munitions.

Definitions.

3. In these Regulations, unless the contrary intention appears—

“approved type” means a type approved by the Minister;

“authorized person” means a person appointed by the Minister to be an authorized person for the purposes of these Regulations;

“gas mask” means any device or apparatus designed, intended or purporting to give protection against lethal, poisonous or noxious gases;

“licensee” means a person who holds a current licence to manufacture gas masks granted under these Regulations.

Licences to manufacture gas masks.

4.—(1.) A person shall not manufacture gas masks except under the authority of a licence granted by the Minister.

(2.) A licence to manufacture gas masks may be granted subject to such conditions and restrictions as are specified in the licence.

Unauthorized sale of gas masks.

5. A person shall not deal in, expose for sale, sell or offer for sale, any gas mask other than a gas mask which—

(a) has been manufactured under a licence granted under these Regulations; or

(b) has been lawfully imported into Australia and is of a type approved by the Minister,

and which bears thereon or on a label securely attached thereto a mark or statement in such form as the Minister directs to indicate that it is of an approved type.

Licensee to comply with conditions.

6. A licensee—

(a) shall not manufacture gas masks of any type other than an approved type;

(b) shall comply with any directions given by the Minister in relation to the placing of a mark or statement on each gas mask or on a label securely attached thereto to indicate that the gas mask is of an approved type; and

(c) shall comply with all conditions and restrictions specified in his licence.

Inspection of premises of licensee.

7. An authorized person may at any time during the working hours inspect the premises used by a licensee for the manufacture of gas masks and may take samples of gas masks for purposes of testing.

Obstruction of authorized person.

8. A licensee shall not obstruct any authorized person in the performance of his duty under these Regulations.

Exemption of gas masks for industrial purposes.

9. These Regulations shall not apply to—

(a) the manufacture or sale of gas masks which are intended to be used solely and exclusively for mining or industrial purposes, if that fact is indicated by a statement appearing on the goods or on a label attached thereto; or

(b)the manufacture of gas masks which are intended solely for experimental purposes and are not sold or offered for sale.
