1941. No. 41.

 

REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

Amendments of National Security (Employment) Regulations. 

Definitions.

1. Regulation 3 of the National Security (Employment) Regulations is amended by omitting from the definition of “the Minister” the word “Munitions” and inserting in its stead the words “Labour and National Service”.

Training and employment of persons for the production of munitions and supplies.

2. Regulation 4 of the National Security (Employment) Regulations is amended by omitting the words “of State for Munitions”.

Regulation of engagement of certain employees.

3. Regulation 5 of the National Security (Employment) Regulations is amended by omitting the words “Director of Labour, Department of Munitions or by a person thereto authorized by the Director of Labour” and inserting in their stead the words “Secretary, Department of Labour and National Service or by a person thereto authorized by the Secretary”.

Marginal rates for tradesmen on production of munitions.

4. Regulation 6 of the National Security (Employment) Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (4.) the words “Painter or” and inserting in their stead the words “or a Ship Painter and”;

(b) by omitting from paragraph (b) of sub-regulation (4.) the words “in the State of New South Wales”; and inserting in their stead the words “(being an iron worker as specified in the first column of the Fourth Schedule to these Regulations)”; and

(c) by omitting from that paragraph, the words “such employee” and inserting in their stead the words “employee in the State of New South Wales”.

First Schedule.

5. The First Schedule to the National Security (Employment) Regulations is amended by omitting the words “Ship Painter and/or Docker” and inserting in their stead the following:—

“Ship Plumbers.

Ship Painters, Writers, Grainers and Gilders.”.

Fourth Schedule.

6. The Fourth Schedule to the National Security (Employment) Regulations is amended—

(a) by omitting the words “and/or” (second occurring) and inserting in their stead the words “or a Ship Painter and”; and

(b) by adding, at the end thereof, the following:—

“Timber Workers in shipyards, as specified in awards made by the Commonwealth Court of Conciliation and Arbitration on the seventh day of April, 1937, the thirteenth day of October, 1937, the sixth day of March, 1939, and the fourth day of March, 1940, in respect of Disputes No. 183 of 1932, No. 225 of 1936, No. 241 of 1936, No. 347 of 1934, No. 80 of 1936, No. 236 of 1936, No. 537 of 1937 and No. 235 of 1939, as varied to date.

Marginal rates prescribed for the respective classifications in such award plus 3s. per week special allowance.”.

Fifth Schedule.

7. The Fifth Schedule to the National Security (Employment) Regulations is amended—

(a) by omitting the words “and/or” and inserting in their stead the words “or a Ship Painter and”;

(b) by adding, at the end thereof, the following:—

“Ship Plumbers in the State of New South Wales as specified in an award made by the State Industrial Commission of New South Wales on the second day of June, 1939 and published in the New South Wales Industrial Gazette, Volume 55, page 1702 and as varied to date.

The rate prescribed in such award plus d. per hour special allowance.

Ship Painters, Writers, Grainers and Gilders in the State of New South Wales as specified in an award made by the State Industrial Court of New South Wales on the twenty- ninth day of June, 1934, and published in the State Industrial Gazette of New South Wales, Volume 45, page 1306 and as varied to date.

The rates prescribed for the respective classifications in such award plus d. per hour special allowance.”.

8. Notwithstanding anything contained in these Regulations, the pay of any employee who, at the commencement of this regulation, was employed in any of the classifications inserted in the Fourth Schedule or the Fifth Schedule, as the case may be, to the National Security (Employment) Regulations, and was in receipt of a higher marginal rate (exclusive of hourly hiring and shift allowance) or, as the case may be, a higher rate than is specified for that classification in the second column of either of those Schedules shall not be reduced by reason of these Regulations.
