REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1943.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1943.

Amendments of the National Security (Egg Industry) Regulations.

1.—(1.) Regulation 5 of the National Security (Egg Industry) Regulations is amended—

Definitions.

(a) by omitting from the definition of “producer” the word “twenty” and inserting in its stead the word “forty-one”; and

(b) by inserting after the definition of “producer” the following definition,—

“‘sell’ includes barter and exchange and ‘sale’ has a corresponding meaning;”.

(2.) The amendment made by paragraph (a) of the last preceding sub-regulation shall be deemed to have had effect from and including the fifteenth day of November, 1943.

2. After regulation 22a of the National Security (Egg Industry) Regulations the following regulation is inserted:—

Regulation of use of eggs in certain cases.

“22b.—(1.) The Minister may, by order published in the Gazette, provide that a producer shall not, except as provided by this regulation, use in, or in connexion with, any hotel, boarding-house, restaurant,

manufacturing business or other business (whether wholesale or retail) which is owned or conducted by him, eggs produced by any fowls or ducks owned by him or under his control.

“(2.) Any such order may be made so as to apply to eggs produced anywhere in the Commonwealth or to eggs produced in any part of the Commonwealth.

“(3.) The Controller may grant a permit to any producer authorizing him to use, subject to such conditions and restrictions (if any) as the Controller determines, in, or in connexion with, any hotel, boarding-house, restaurant, manufacturing business, or other business (whether wholesale or retail) which is owned or conducted by him, eggs produced by any fowls or ducks owned by him or under his control.

“(4.) A person holding a permit granted under the last preceding sub-regulation may, notwithstanding any order under sub-regulation (1.) of this regulation, use eggs in accordance with the terms of the permit and shall comply with the conditions and restrictions (if any) to which the permit is subject.”.
