REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939–1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939–1940.

National Security (Control of Animal Diseases) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Control of Animal Diseases) Regulations.

Administration.

2. These Regulations shall be administered by the Minister of State for Health.

Interpretation.

3. Expressions used in these Regulations shall have the same meanings as in the Quarantine Act 1908–1924.

Food refuse to be treated before use.

4. A person shall not use for feeding to animals any food refuse which has been removed from any naval, military or air force encampment or establishment unless the refuse has been treated by boiling or by some other process of heating approved by a Chief Quarantine Officer.

Precautions to be observed with respect to food refuse.

5. The owner of any animal to which any such food refuse is to be fed shall—

(a) retain the refuse in containers in a place to which animals have not access until the refuse has been treated as required by the last preceding regulation;

(b) cleanse all containers and vehicles in his possession used for collecting or retaining the refuse; and

(c) dispose of all residue remaining after the cleansing treatment.

Persons removing food refuse to give notice.

6. Any person who undertakes to remove, or removes, food refuse from any naval, military or air force encampment or establishment shall forthwith notify a Chief Quarantine Officer and, if any such refuse is to be used for the purpose of feeding to animals, he shall furnish to the Chief Quarantine Officer particulars of the apparatus to be used for the treatment of the refuse.

Power to enter premises.

7. Any quarantine officer or other person authorized in that behalf by a Chief Quarantine Officer shall have power to enter any premises and to make inspections for the purpose of ascertaining whether the provisions of these Regulations are being complied with.

Directions as to manner of compliance with Regulations.

8. A quarantine officer or person authorized under the last preceding regulation may give directions as to the manner in which the provisions of regulations 4, 5 and 6 of these Regulations shall be complied with and a person shall comply with all such directions as are so given to him.

Destruction of animals on overseas vessels.

9.—(1.) The master of any oversea vessel which enters any port in Australia shall, if so required by a quarantine officer, destroy any cattle, sheep, goats, other ruminants, swine, fowls, ducks, turkeys, geese or Guinea fowls thereon unless the animals may lawfully be imported into Australia and, if such requirement is not carried out forthwith, a quarantine officer may destroy the animals.

(2.) The master of any vessel on which any animal has been destroyed in accordance with the provisions of the last preceding sub-regulation shall—

(a) dispose of the carcass, offal, hide, skin and manure of the animal in accordance with the directions of a quarantine officer;

(b) cleanse and disinfect the stalls, pens, or crates occupied by the animal in a manner approved by a quarantine officer.

Quarantine officer may destroy uncontrolled animals.

10. A quarantine officer may destroy any dog, cat or undomesticated animal which is neither intended nor permitted to be imported into Australia and which is on an oversea vessel which enters a port in Australia, if the animal is not controlled on the vessel in a manner approved by a Chief Quarantine Officer, or if the master of the vessel refuses to enter into a bond as required by regulation 59 of the Quarantine (Animals) Regulations.

Master of vessel to render assistance.

11. The master of an oversea vessel shall render all reasonable assistance to a quarantine officer in the carrying out of his duties under either of the last two preceding regulations.
