REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939–1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939–1940.

National Security (Australian Industrial Relations Council) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Australian Industrial Relations Council) Regulations.

Administration.

2. These Regulations shall be administered by the Minister of State for Labour and National Service.

Purpose.

3. The purpose of these Regulations is to establish a body which shall assist the Government of the Commonwealth in the realization of its objective of achieving and maintaining continuous production at the highest possible level in all branches of industry throughout Australia for the duration of the war.

Definitions.

4. In these Regulations, unless the contrary intention appears—

“the appropriate Minister of State” means the Minister of State under whose administration lies the subject-matter being dealt with by the Council;

“the Council” means the Australian Industrial Relations Council constituted under these Regulations.

Australian Industrial Relations Council.

5.—(1.) There shall be an Australian Industrial Relations Council consisting of the appropriate Minister of State, a Chairman, and sixteen other members.

25.—Price 3d.

(2.) The Chairman of the Council shall be a person who holds or has held the office of Justice of the High Court or Judge of the Supreme Court of a State and shall hold office on such terms and conditions as the Governor-General determines.

(3.) The members of the Council, other than the appropriate Minister of State, shall be appointed by the Governor-General, and, except the Chairman, shall hold office during the pleasure of the Governor-General.

(4.) Of the sixteen other members, eight shall be appointed to represent employers and eight shall be appointed to represent employees.

Meetings.

6.—(1.) Meetings of the Council shall be held at such times and places as the Chairman from time to time determines.

(2.) The Minister or the appropriate Minister of State or the Chairman may, at any time, and the Chairman shall, if requested so to do by not less than six members of the Council, convene a meeting of the Council.

(3.) The Council may make its own rules of procedure and may determine its quorum.

(4.) The Council shall keep a record of its proceedings.

Functions of Council.

7. The functions of the Council shall be—

(a) to advise the Government of the Commonwealth in relation to the matters specified in the agenda of the Conference on Industrial matters held at Canberra on the 27th and 28th December, 1941;

(b) to consult with that Government and to advise it generally on problems affecting war production; and

(c) to make recommendations to the Government of the Commonwealth upon such industrial matters as are from time to time dealt with, or proposed to be dealt with, by Regulations under the National Security Act 1939–1940.

Staff.

8. The Minister shall provide the Council with an Executive Officer, and with such staff as is necessary for the efficient performance of the functions of the Council.

Allowances.

9. There shall be payable to each member of the Council, other than the appropriate Minister of State and the Chairman, such fees and allowances, and, to the Chairman, such travelling allowances, as the Governor-General determines.
