REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939–1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939–1940.

Amendments of the National Security (Apple and Pear Acquisition) Regulations.

Australian Apple and Pear Marketing Board.

1. Regulation 4 of the National Security (Apple and Pear Acquisition) Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “ and six other members representing respectively each of the six States “ and inserting in their stead the words “and an Executive Member”; and

(b) by omitting sub-regulation (3.).

Meetings of the Board.

2. Regulation 5b of the National Security (Apple and Pear Acquisition) Regulations is amended by omitting sub-regulations (2.), (3.) and (4.).

3. Regulation 5c of the National Security (Apple and Pear Acquisition) Regulations is repealed, and the following Regulation is inserted in its stead:—

Advisory Council.

“5c—(1.) For the purposes of these Regulations there shall be an Advisory Council of six members, consisting of the Chairman of each State Committee, or a member of the State Committee appointed by that Chairman to act as his deputy.

“(2.) The functions of the Advisory Council shall be to advise the Board on matters submitted to it by the Board, and to make recommendations to the Board on other matters arising out of these Regulations.

“(3.) Meetings of the Advisory Council shall be held at such times and places as the Board from time to time determines, or as the Minister directs.

“(4.) At any meeting of the Advisory Council a majority of the members thereof shall constitute a quorum.

“(5.) The members present at each meeting of the Advisory Council shall elect one of their number to act as Chairman of that meeting.

“(6.) All questions before the Advisory Council shall be decided by a majority of votes.

“(7.) At any meeting of the Advisory Council the Chairman shall have a deliberative vote only.

“(8.) Members of the Board shall have the right to attend and take part in proceedings of any meeting of the Advisory Council but shall not vote or be included in any quorum.”.

State Committees.

4. Regulation 6 of the National Security (Apple and Pear Acquisition) Regulations is amended by omitting sub-regulation (4.) and inserting in its stead the following sub-regulation:—

“(4.) Each State Committee shall appoint one of its members to be the Chairman of the Committee and another member to be the Deputy Chairman.”.

Deputies.

5. Regulation 6a of the National Security (Apple and Pear Acquisition) Regulations is amended by omitting the proviso to sub-regulation (1.).

Indemnity.

6. Regulation 6b of the National Security (Apple and Pear Acquisition) Regulations is amended—

(a) by inserting after the word “Board” (first occurring) the words “or of the Advisory Council”; and

(b) by inserting after the word “Board” (second occurring) the words “, Advisory Council”.

Remuneration of members.

7. Regulation 6c of the National Security (Apple and Pear Acquisition) Regulations is amended by inserting after the word “Board” the words “or of the Advisory Council”.
