REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

National Security (Allied Works) Regulations.

Citation.

1. These Regulations may be cited as the National Security (Allied Works) Regulations.

Administration.

2.These Regulations shall be administered by the Minister of State for the Interior.

Definition.

3. In these Regulations—

“the Director-General means the Director-General of Allied Works appointed under these Regulations.”

Director-General of Allied Works.

4.—(1.) There shall be a Director-General of Allied Works who shall have such powers and functions as are specified in these Regulations.

(2.) The Director-General shall be appointed by the Minister on such terms and conditions as the Minister thinks fit, and may be paid such allowances as the Minister determines.

General functions of Director-General.

5. The Director-General shall have the direction and control of the following matters:—

(a) The carrying out of works of whatever nature required for war purposes by Allied Forces in Australia;

(b)The securing of supplies of materials, plant, tools, and equipment for the purposes of such works;

(c) The employment of technicians, workmen and others for the purposes of such works, and the transport, accommodation and provisioning of such workmen and others.

Special powers of Director-General.

6. In the exercise of his functions under these Regulations, the Director-General may, on behalf of the Commonwealth, and subject to any directions of the Minister—

(a) make and vary contracts or agreements;

(b) employ such persons as are necessary;

(c) direct any contractor with the Commonwealth, or any person sub-contracting with such a contractor, as to the manner of carrying out the work for which he has contracted or sub-contracted;

(d)requisition or compulsorily acquire any property (other than land) including exclusive rights or licences and privileges;

(e) acquire by purchase any goods or chattels or things in action (including rights in relation to inventions); and

(f) sell or otherwise dispose of or turn to account or write off property held in connexion with the carrying out of works.

Delegation by Director-General.

7.—(1.) The Director-General may, by writing under his hand, delegate all or any of his powers and functions under these Regulations (except this power of delegation) so that the delegated powers and functions may be exercised by the delegate.

(2.) Every delegation under these Regulations shall be revocable at will, and no delegation shall prevent the exercise of any power or function by the Director-General.

Conditions of employment.

8. Persons employed in pursuance of these Regulations shall not be subject to the Commonwealth Public Service Act 1922-1941, but shall be employed upon such terms and conditions as the Director-General determines.
