1940. No. 192.

REGULATIONS UNDER THE NATIONAL SECURITY ACT 1939-1940.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Security Act 1939-1940.

Amendment of National Security (Aircraft Production Commission) Regulations. 

Annual Report.

1. Regulation 20 of the National Security (Aircraft Production Commission) Regulations is amended by omitting the words “for submission to the Minister”.

Officers and Employees.

2. Regulation 21 of the National Security (Aircraft Production Commission) Regulations is amended—

(a) by omitting from sub-regulation (3.) the words “be appointed” and inserting in their stead the words “have been appointed”;

(b)by adding at the end of sub-regulation (3.) the words “but shall be engaged for such periods and shall be subject to such conditions as are determined by the Commission”; and

(c) by adding at the end thereof the following sub-regulation:—

“(4.) If an officer of the Public Service of the Commonwealth is employed by the Commission, the Officers’ Rights Declaration Act 1928-1933, shall apply

as if these Regulations and this regulation were an Act and section, respectively, and had been specified in the Schedule to that Act.”

3. After regulation 21 of the National Security (Aircraft Production Commission) Regulations the following regulation is added:—-

Delegation.

“22.—(1.) The Commission may delegate all or any of its powers and functions under these Regulations (except this power of delegation) so that the delegated powers and functions may be exercised by the delegate.

“(2.) Every delegation under this regulation shall be revocable at will, and no delegation shall prevent the exercise of any power or function by the Commission.”.
