REGULATIONS UNDER THE NATIONAL
SECURITY ACT 1939-1940.*
I,
THE DEPUTY OF THE GOVERNOR-GENERAL in and over the Commonwealth of Australia,
acting with the advice of the Federal Executive Council, hereby make the
following Regulations under the National
Security Act 1939-1940.

National Security (Agricultural
Machinery) Regulations.
Citation.
1. These
Regulations may be cited as the National Security (Agricultural Machinery)
Regulations.
Administration.
2. These
Regulations shall be administered by the Minister of State for Commerce and
Agriculture.
Objects.
3. The
objects of these Regulations are to control the manufacture, supply,
distribution, use, repair and servicing of agricultural machinery in order to
ensure that, for the purposes of the defence of the Commonwealth and the
effectual prosecution of the war, sufficient agricultural machinery is
available and that such machinery is used to the best advantage, and these
Regulations shall be administered accordingly.
Definitions.
4. In
these Regulations, “agricultural
machinery” includes all machinery used in agricultural, horticultural, pastoral
and dairying production.
Power
of Minister to make orders.
5.—(1.) The Minister may,
by order, make provision for—
(a) regulating, increasing, restricting
or prohibiting the manufacture, purchase, sale, disposal, storage, distribution
and use of agricultural machinery;
(b) regulating the carrying on of any
undertaking engaged in the manufacture of agricultural machinery;
(c) the repair and servicing of
agricultural machinery; and
(d)the furnishing of returns, or the supply of information, relating to
agricultural machinery.

(2.) Any order under the last
preceding sub-regulation may be absolute or subject to such conditions and
restrictions as are specified in the order and may contain such incidental and
supplementary provisions as are necessary for the purposes of the order.
(3.) The Minister may, on behalf of
the Commonwealth, purchase, use, sell or otherwise dispose of agricultural
machinery.
Arrangements
with States.
6. The Governor-General
may enter into an arrangement with the Governor of any State providing for any
matter necessary or convenient for the purpose of carrying out or giving effect
to these Regulations.
Powers
of inspection.
7. For the purposes of
these Regulations, any person thereto authorized by the Minister or by the
Director-General of Agriculture may, at any reasonable time, enter any premises
used in connexion with the manufacture of agricultural machinery and may inspect
the premises and any plant therein used in the manufacture of agricultural
machinery, and may also inspect any accounts, books and documents relating
thereto or the use thereof.
Committees.
8. For
the purposes of these Regulations the Minister may appoint, on such terms and conditions
as he determines, such committees as he considers desirable.
Controller
of Agricultural Machinery.
9. The Minister may appoint
a Controller of Agricultural Machinery who shall not be subject to the Commonwealth Public Service Act 1922-1941
and shall hold office on such terms and conditions as the Minister determines.
Officers.
10.—(1.)
The Director-General of Agriculture may appoint such officers as he considers
necessary for the purposes of these Regulations.
(2.) Officers so appointed shall
not be subject to the Commonwealth Public
Service Act 1922-1941, and shall hold office on such terms and conditions
as the Director-General of Agriculture determines.
(3.) Where a person appointed in
pursuance of this regulation was, immediately prior to his appointment, an
officer of the Public Service of the Commonwealth, his service as an officer
under these Regulations shall, for the purpose of determining his existing and
accruing rights, be taken into account as if it were service in the Public
Service of the Commonwealth and the Officers’ Rights Declaration Act 1928-1940
shall apply as if this regulation were a section of an Act and that Act and
section were specified in the Schedule to the Officers’ Rights
Declaration Act 1928-1940.
Delegation.
11.—(1.) The
Director-General of Agriculture may delegate to any person all or any of his
powers and functions under these Regulations.
(2.) Any such delegation shall be
revocable at will and no delegation shall prevent the exercise of any such
power or function by the Director-General.
