National Parks (Tour Operator Licence Fee) Amendment Regulations 2018

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the National Parks (Tour Operator Licence Fee) Regulations 2011 to reflect amendments made to the National Parks Act 1975 by the Parks Victoria Act 2018.

2Authorising provision

These Regulations are made under section 48AA of the National Parks Act 1975.

3Commencement

These Regulations come into operation on 12 September 2018.

4Principal Regulations

In these Regulations, the National Parks (Tour Operator Licence Fee) Regulations 2011[1] are called the Principal Regulations.

5Definitions

In regulation 4 of the Principal Regulations, in the definition of use fee, for "the Secretary" substitute "Parks Victoria".

6Use fee for a standard licence

In regulation 8(1) of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

7Use fee form

In regulation 11(2)(c) of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

8Application of Part

In regulation 12 of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

9Annual licence fees for competitively allocated licence

(1)In regulation 14(1)(a) of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

(2)In regulation 14(2) of the Principal Regulations, for "the Secretary or person authorised under subregulation (1)(a)" substitute "Parks Victoria".

10Use fee for a competitively allocated licence

In regulation 15(1) of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

11Use fee form

In regulation 16(2)(c) of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

12Reduction, waiver or refund of licence fees

(1)In regulation 17(1) of the Principal Regulations, for "the Secretary" substitute "Parks Victoria".

(2)In regulation 17(3) of the Principal Regulations, for "the Secretary, on his or her own motion," substitute "Parks Victoria, on its own motion,".

13Surrender of licence

In regulation 19 of the Principal Regulations, for "The Secretary" substitute "Parks Victoria".
