National Parks and Wildlife Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the National Parks and Wildlife Conservation Act 1975.

1.   Amendment

1.1   The National Parks and Wildlife Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 46 (Interpretation)

2.1   Definition of “protected animal”:

Subparagraph (a) (ii):

Omit the subparagraph, substitute:

  • “(ii)

    an animal declared under regulation 48:

    • (A)

      not to be a protected animal; or

    • (B)

      not to be protected in a specified place or in a specified circumstance; or”.

3.   Regulation 48 (Animals and plants may be declared to be not protected)

3.1   Paragraph 48 (1) (a):

Omit the paragraph, substitute:

  • “(a)

    an animal, other than an animal specified in Schedule 1, 2, or 3:

    • (i)

      is not a protected animal; or

    • (ii)

      is not protected in a specified place; or

    • (iii)

      is not protected in a specified circumstance; and”.
