National Parks and Wildlife Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the National Parks and Wildlife Conservation Act 1975.

After regulation 20c of the National Parks and Wildlife Regulations the following regulation is inserted:

Reconsideration and review of decisions of Director

“20d. (1) In this regulation, ‘decision’ has the same meaning as in the Administrative Appeals Tribunal Act 1975.

“(2) A person whose interests are affected by a decision of the Director under these Regulations, not being—

(a) a decision under regulation 8b; or

(b) a decision that is deemed to be a decision under these Regulations by sub-section 43 (6) of the Administrative Appeals Tribunal Act 1975,

may, if he is dissatisfied with the decision, by notice in writing given to the Director within 21 days after the day on which the decision first comes to the notice of the person, request the Director to reconsider the decision.

“(3) An organization or association of persons, whether incorporated or not, shall be taken to have interests that are affected by a decision if the decision relates to a matter included in the objects or purposes of the organization or association.

“(4) Sub-regulation (3) does not apply in relation to a decision given before the organization or association was formed or before the objects or purposes of the organization or association included the matter concerned.

“(5) There shall be set out in the request the reasons for making the request.

“(6) The Director shall, within 1 month after the day on which he receives the request, reconsider the decision and may make any decision that he might have made in the first instance.

“(7) The Director shall give to the person who has requested the reconsideration of the decision notice in writing of the decision made under sub-regulation (6).

“(8) An application may be made to the Administrative Appeals Tribunal for the review of a decision by the Director made under sub-regulation (6).”.
