Act No. 21, 1989

An Act to amend the National Parks and Wildlife Act 1974 with respect to the protection of marine mammals. [Assented to 20 April 1989]

National Parks and Wildlife (Marine Mammals Protection) Amendment 1989

The Legislature of New South Wales enacts:

Short title

1. This Act may be cited as the National Parks and Wildlife (Marine

Mammals Protection) Amendment Act 1989.

Commencement

2.     This Act commences on a day to be appointed by proclamation.

Amendment of National Parks and Wildlife Act 1974 No. 80, sec. 99 (Taking or killing etc. endangered fauna)

3. The National Parks and Wildlife Act 1974 is amended—

(a) by inserting at the end of section 99 (1) (b) the following matter:

(c)

approach a marine mammal any closer than such distance as may be prescribed by the regulations or interfere with a marine mammal.

(b) by inserting after section 99 (3) the following subsections:

(4) A reference in section 112F, 120, 129 or 171 to taking or killing any fauna includes, so far as is applicable in relation to a marine mammal, approaching or interfering with the marine mammal as referred to in subsection (1) (c).

(5) In this section—

"interfere with" includes harass, chase, herd, tag, mark and brand.
