Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the National Parks and Wildlife Act 1974.

Explanatory note
The object of this Regulation is to amend the National Parks and Wildlife Regulation 2009 as a consequence of the replacement of the Public Health Act 1991 with the Public Health Act 2010, and the Public Health (Microbial Control) Regulation 2000 and the Public Health (Swimming Pools and Spa Pools) Regulation 2000 with the Public Health Regulation 2012, respectively.
More specifically, the Regulation enables the Director-General to appoint a member of staff of the Office of Environment and Heritage to exercise certain functions of an authorised officer under the Public Health Act 2010 or the Public Health Regulation 2012, and to exercise certain functions of a local government authority under the Public Health Act 2010, within Kosciuszko National Park in respect of air-conditioning systems and other regulated systems, public swimming pools and spa pools and premises on which skin penetration procedures are carried out.
This Regulation is made under the National Parks and Wildlife Act 1974, including Part 13 (the general regulation-making provisions).

1 Name of Regulation
This Regulation is the National Parks and Wildlife Amendment (Public Health)
Regulation 2013.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.

Clause 44
Omit the clause. Insert instead:
44 Functions relating to Public Health Act 2010
The Director-General may exercise the following functions in relation to the park:
(a) the functions of a local government authority under Part 9 of the Public Health Act 2010 to appoint a member of staff of the Office of Environment and Heritage to exercise the functions of an authorised officer under:
(i) Divisions 2, 3, 4 and 5 of Part 3 of that Act, and (ii) Part 8 of that Act, and
(iii) Parts 2, 3, 4 and 9 and Schedules 1 and 4 to the Public Health Regulation 2012, (b) the functions of a local government authority under Part 3 of the Public Health Act 2010.
