(ABORIGINAL OWNERSHIP) ACT 1996 No 142—

PROCLAMATION*

GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (1) of the National Parks and Wildlife Amendment (Aboriginal Ownership) Act 1996, do, by this my Proclamation, appoint 2 May 1997 as the day on which that Act (other than Schedule 4, and section 6 in its application to that Schedule) commences.

EXPLANATORY NOTE

The object of this Proclamation is to commence the whole of the National Parks and Wildlife Amendment (Aboriginal Ownership) Act 1996 other than Schedule 4 (and section 6 in its application to that Schedule). That Schedule, which makes certain amendments to provisions dealing with state recreation areas and regional parks, commences on the commencement of the National Parks and Wildlife Amendment Act 1996.

* The proclamation appointed 2.5.1997 as the date of commencement. Pursuant to s 23 (5) of the Interpretation Act 1987, the proclamation does not fail merely because it was not published in the Gazette until after the day appointed in the proclamation, but s S 23 (5) provides, in that event, for the Act to commence on the day on which the proclamation was published in the Gazette.
