NATIONAL PARKS AND WILDLIFE ACT 1974—

REGULATION

(Relating to licences, fees, royalties and the keeping of reptiles)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the National Parks and Wildlife Act 1974, has been

pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 19th March, 1993.

Amendments

2. The Fauna Protection Regulations 1949 are amended:

(a) by omitting Regulations 3B and 11B and Forms 15, 30 and 31;

(b)

by omitting from Regulation 8 (1) (a) the matter “175” and by inserting instead the matter “200”;

(c)

by omitting from Regulation 8 (1) (c) the matter “130” and by inserting instead the matter “300”;

(d)

by omitting from Regulation 8 (1) (g) the matter “65” and by inserting instead the matter “150”;

(e)

by omitting Regulation 8 (1) (k) and by inserting instead the following paragraphs:

(k) for a game licence (ducks) .................................... 40

(k1) for a game licence (quail) ........................................ 20

(f)

by omitting from Regulation 8 (1) (l) the matter “340” and by inserting instead the matter “390”;

(g) by omitting from Regulation 8 (1) (m) the matter “20” and by inserting instead the matter “30”;
(h) by omitting from Regulation 8 (1) (n) the matter “10” and by inserting instead the matter “15”;

(i)  by omitting from Regulation 8 (2) (a) the words “without fee” and by inserting instead the words “on payment of half the prescribed fee”;

(j)

by omitting from Regulation 15B (1) the matter “$2.00” and by inserting instead the matter “$2.50”.

EXPLANATORY NOTE

The object of this Regulation is to amend the Fauna Protection Regulations 1949

so as:

(a)

to repeal the requirement that a game licence must be in a form specified in the Regulations; and

(b)

to repeal requirements that certain persons keeping reptiles must be registered, provide returns concerning the reptiles and comply with other requirements with respect to the keeping of reptiles; and

(c)

to increase fees payable for trappers’, fauna dealers’, exhibitors’ and import and export licences and for certificates of registration of premises and additional premises and aviary registration certificates; and

(d) to provide for different fees for duck and quail licences; and

(e)

to provide that pensioners must pay one half of the prescribed fee for a game licence instead of being exempt from payment of a fee as at present; and

(f)

to increase the royalty payable by the holders of trappers’ licences for fauna taken or killed.

This Regulation is made under the National Parks and Wildlife Act 1974,

including section 143 and section 154 (a general regulation making power).
