National Parks Amendment (Fisheries) Regulations 2020

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the National Parks Regulations 2013 to update the definition of commercial fishing vessels.

2Authorising provision

These Regulations are made under section 48 of the National Parks Act 1975.

3Commencement

These Regulations come into operation on 19 February 2020.

4Principal Regulations

In these Regulations, the National Parks Regulations 2013[1] are called the Principal Regulations.

5Definitions

(1)In regulation 128 of the Principal Regulations, in paragraph (a)(i) of the definition of commercial fishing vessels, after "regulation 12(c) of the Fisheries Regulations 2009³" insert "(as in force immediately before the revocation of those Regulations) or regulation 14(c) of the Fisheries Regulations 2019".

(2)In regulation 128 of the Principal Regulations, in paragraph (a)(ii) of the definition of commercial fishing vessels, after "regulation 12(r) of the Fisheries Regulations 2009" insert "(as in force immediately before the revocation of those Regulations) or regulation 14(s) of the Fisheries Regulations 2019".

(3)In regulation 128 of the Principal Regulations, in paragraph (a)(iii) of the definition of commercial fishing vessels, after "regulation 12(m) of the Fisheries Regulations 2009" insert "(as in force immediately before the revocation of those Regulations) or regulation 14(n) of the Fisheries Regulations 2019".

(4)In regulation 128 of the Principal Regulations, in paragraph (a)(iv) of the definition of commercial fishing vessels, after "regulation 12(sb) of the Fisheries Regulations 2009" insert "(as in force immediately before the revocation of those Regulations) or regulation 14(v) of the Fisheries Regulations 2019".

(5)In regulation 128 of the Principal Regulations, in paragraph (a)(v) of the definition of commercial fishing vessels, after "regulation 12(x) of the Fisheries Regulations 2009" insert "(as in force immediately before the revocation of those Regulations) or regulation 14(za) of the Fisheries Regulations 2019".

(6)In regulation 128 of the Principal Regulations, for paragraph (a)(vi) of the definition of commercial fishing vessels substitute—

"(vi)a Banded Morwong Fishery Access Licence under regulation 14(e) of the Fisheries Regulations 2019;

(vii)an Octopus Fishery Access Licence under regulation 14(o) of the Fisheries Regulations 2019;

(viii)a statutory fishing right within the meaning of the Fisheries Management Act 1991 of the Commonwealth;".
