An Act to transfer certain State forest and other Crown lands in the Southern region of the State to the national park estate, and for other purposes.

Part 1Preliminary1Name of Act

This Act is the National Park Estate (Southern Region Reservations) Act 2000.

2Commencement

This Act commences on 1 January 2001, unless commenced sooner by proclamation.

3Definitions

In this Act:

Crown land means Crown land within the meaning of the Crown Land Management Act 2016.

national park estate means:

  • (a)

    land declared as a wilderness area under the Wilderness Act 1987 or the National Parks and Wildlife Act 1974, or

  • (b)

    land reserved or dedicated under the National Parks and Wildlife Act 1974, or

  • (c)

    land dedicated or set apart as a flora reserve under the Forestry Act 1916, or

  • (d)

    land dedicated or reserved for a similar public purpose under the Crown Land Management Act 2016, or

  • (e)

    land vested in the Minister administering the National Parks and Wildlife Act 1974 for the purposes of Part 11 of that Act.

National Parks and Wildlife Reserve Trust means the National Parks and Wildlife Reserve Trust as reconstituted by section 9 of the National Park Estate (Land Transfers) Act 1998.

State forest means land dedicated under the Forestry Act 1916 (or under the former Forestry Act 1909) as a State forest, being a dedication that is in force.

Part 2Land transfers to national park estate4Revocation of dedication of certain lands as State forest and of reservation of associated flora reserves(1)

The dedication as State forest of the following lands is revoked:

  • (a)

    lands described in Schedule 1,

  • (b)

    lands described in Part 1 of Schedule 4,

  • (c)

    lands described in Schedule 5.

(2)

Any notices under section 25A of the Forestry Act 1916 that set apart, as flora reserves, areas of State forests whose dedication is revoked by subsection (1) are also revoked by this Act, but only to the extent to which they relate to flora reserves situated (or partly situated) within the lands referred to in that subsection.

(3)

Any notifications under section 19A of the Forestry Act 1916 that declare, as national forests, areas of State forests whose dedication is revoked by subsection (1) are also revoked by this Act, but only to the extent to which they relate to national forests or parts of national forests situated within the lands referred to in that subsection.

5Reservation or dedication of former State forest as national park, nature reserve or state recreation area(1)

The lands described in Schedule 1 are reserved or dedicated under the National Parks and Wildlife Act 1974 as, or as part of, the following (as indicated in that Schedule):

  • (a)

    national parks,

  • (b)

    nature reserves,

  • (c)

    state recreation areas.

(2)

This section does not apply to any land described in Schedule 1 that is also described in Schedule 5.

6Reservation or dedication of Crown lands as national park, nature reserve or state recreation area(1)

The lands described in Schedule 2 are reserved or dedicated under the National Parks and Wildlife Act 1974 as, or as part of, the following (as indicated in that Schedule):

  • (a)

    national parks,

  • (b)

    nature reserves,

  • (c)

    state recreation areas.

(2)

Any timber reserves (within the meaning of the Forestry Act 1916) with respect to land referred to in subsection (1) are revoked by this Act, but only to the extent to which they relate to timber reserves or parts of timber reserves situated within those lands.

(3)

Subsection (1) does not apply to any land described in Schedule 2 that is also described in Schedule 5.

7Setting apart of areas in State forests as flora reserves

The lands described in Schedule 3 that are within State forests are set apart as, or as part of, flora reserves under the Forestry Act 1916 (as indicated in that Schedule).

8Dedication of certain former State forests, Crown land and other land and their management by National Parks and Wildlife Reserve Trust(1)

Any land described in Schedule 4 (the dedicated land) that was taken to be dedicated under the Crown Lands Act 1989 as provided by this section immediately before the repeal day continues on and from that day to be Crown land dedicated for the same purposes under the Crown Land Management Act 2016.

(2)

The National Parks and Wildlife Reserve Trust is taken to have been appointed on and from the repeal day as the sole Crown land manager under the Crown Land Management Act 2016 of the dedicated land.

(3)

The Crown Land Management Act 2016 applies in relation to the dedicated land and to the National Parks and Wildlife Reserve Trust in its capacity as its Crown land manager, subject to the following modifications:

  • (a)

    the Trust’s appointment as the Crown land manager of the dedicated land cannot be revoked under the Crown Land Management Act 2016,

  • (b)

    no other person can be appointed under the Crown Land Management Act 2016 as a Crown land manager of the dedicated land,

  • (c)

    the Trust is taken to have been assigned as a category 2 non-council manager of the dedicated land for the purposes of Division 3.5 of the Crown Land Management Act 2016,

  • (d)

    clause 7 (1) of Schedule 7 to the Crown Land Management Act 2016 is taken to extend to any estate in fee simple in the dedicated land vested in the National Parks and Wildlife Reserve Trust (before it was reconstituted) by section 100 of the Crown Lands Act 1989,

  • (e)

    if the Minister is not also the Crown land Minister, the Minister can:

    • (i)

      exercise the functions of the Crown land Minister under Part 2 of the Crown Land Management Act 2016 instead of the Crown land Minister in relation to the dedicated land, except a function under any of the provisions referred to in paragraph (f), and

    • (ii)

      grant written consent for the purposes of Division 3.5 of the Crown Land Management Act 2016,

  • (f)

    the regulations under this Act may prescribe kinds of functions for the purposes of section 3.27 (2) (c) of the Crown Land Management Act 2016 in addition to any functions prescribed by the regulations under that Act and, consequently, written Ministerial consent is not required for the exercise of such a function by the Trust,

  • (g)

    the Crown Land Management Act 2016 does not apply in relation to the dedicated land or the Trust to the extent provided by other provisions of this Act or the regulations.

(4)

If the Minister exercises any function of the Crown land Minister permitted by this section, the exercise of the function has the same effect as if it had been duly exercised by the Crown land Minister.

(5)

In this section:

Crown land Minister means the Minister administering the Crown Land Management Act 2016.

repeal day means the day on which the Crown Lands Act 1989 is repealed by the Crown Land Management Act 2016.

9Vesting in NPW Minister of certain former State forests(1)

The lands described in Schedule 5 vest in the Minister administering the National Parks and Wildlife Act 1974 on behalf of the Crown for the purposes of Part 11 of the National Parks and Wildlife Act 1974 for an estate in fee simple, freed and discharged from:

  • (a)

    all trusts, obligations, estates, interests, rights of way or other easements, and

  • (b)

    any dedication, reservation, Crown grant or vesting to which the lands were subject, and any such dedication, reservation, grant or vesting is revoked by the operation of this section.

(2)

Despite subsection (1), the lands described in Schedule 5 are not freed and discharged from any continued perpetual lease, continued special lease or continued term lease within the meaning of Schedule 1 to the Crown Land Management Act 2016 (or from rights or interests arising under an incomplete purchase within the meaning of that Act of land that was formerly under a lease of that kind) to which the lands were subject immediately before their vesting under this section.

10Adjustment of description of land transferred to national park estate(1)

The description of any land in Schedules 1–6 may be adjusted in accordance with this section.

(2)

A description of land may be adjusted from time to time:

  • (a)

    to alter the boundaries of the land for the purposes of the effective management of national park estate land and State forest land, including adjustments to enable boundaries to follow distinctive land features, to provide access to land or to rationalise the boundaries of similar areas of land, or

  • (b)

    to adjust the boundary of any land adjoining a public road, including adjustments to enable the boundary to follow the formed path of the road or to provide an appropriate set back from the carriageway of the road, or

  • (c)

    to include, remove or change a description of any easement or restriction to which the land is subject.

(3)

An adjustment of the description of land is to be made by the Director-General of National Parks and Wildlife by a notice published on the NSW legislation website that amends Schedules 1–6.

(4)

A notice under this section may only be published with the approval of:

  • (a)

    the Minister administering the National Parks and Wildlife Act 1974, and

  • (b)

    the Minister administering the Forestry Act 1916, and

  • (c)

    to the extent that the notice applies to any Crown land (other than land reserved or dedicated under the National Parks and Wildlife Act 1974 or the Forestry Act 1916)—the Minister administering the Crown Land Management Act 2016, and

  • (c1)

    to the extent that the notice applies to a Crown road—the Minister administering the provisions of the Roads Act 1993 relating to Crown roads, and

  • (d)

    to the extent that the notice applies to a classified road—the Minister administering the provisions of the Roads Act 1993 relating to classified roads.

(5)

The Director-General of National Parks and Wildlife is required to certify in any notice under this section that the adjustments effected by the notice will not result in any significant reduction in the size or value of national park estate land or State forest land.

(6)

An adjustment of the description of land may only be made before:

  • (a)

    31 March 2001, except as provided by paragraph (b) or (c), or

  • (b)

    in the case of an adjustment of the description of any land in or to be included in Schedule 5—31 December 2005, or

  • (c)

    in the case of an adjustment of the boundary of land adjoining a public road—31 December 2007.

(7)

If any of the land described in Schedules 1–6 on the commencement of those Schedules is not included in the adjusted description of the land, the land that is not so included is taken never to have been subject to or affected by this Act or the relevant Schedule (except as provided by subsection (9)).

(8)

If land included in the adjusted description of the land includes any land not described in Schedules 1–6 on the commencement of those Schedules, the land concerned is taken to have been subject to this Act and the relevant Schedule on the commencement of this Act.

(9)

The Director-General of National Parks and Wildlife may, in a notice published under this section for the purpose of adjusting the boundary of land adjoining a public road, declare that:

  • (a)

    any such land (described in the notice) is part of that public road and, accordingly, is vested in the roads authority for that public road under the Roads Act 1993 or is Crown land, and

  • (b)

    any such land (described in the notice) ceases to be part of that public road and, accordingly, is divested from the relevant roads authority or from the Crown and becomes part of the land subject to the relevant provisions of this Act applicable to the Schedule to this Act in which the land is included.

A declaration under this subsection has effect according to its tenor, despite anything to the contrary in the Roads Act 1993.

(10)

For the purposes of this section:

  • (a)

    Crown road, public road or classified road means a Crown road, public road or classified road, respectively, within the meaning of the Roads Act 1993, and

  • (b)

    land adjoining a public road includes land in the vicinity of a public road.

(11)

Anything done before the commencement of the amendments to this section by the National Parks and Wildlife Amendment Act 2010 that would have been validly done had those amendments been in force when it was done is validated.

11Changes within national park estate(1)

The reservation or dedication under the National Parks and Wildlife Act 1974 as national park or nature reserve of the land described in Part 1 of Schedule 6 is revoked and the land is reserved under that Act as part of Gulaga National Park.

(2)

The reservation under the National Parks and Wildlife Act 1974 of land as Burrinjuck State Recreation Area is revoked and:

  • (a)

    that part of that land that is described in Part 2 of Schedule 6 is dedicated as part of Burrinjuck Nature Reserve under that Act, and

  • (b)

    the balance of that land is Crown land dedicated for the purposes of public recreation under the Crown Land Management Act 2016.

12Land transfers—ancillary and special provisions

Schedule 7 has effect.

Part 3Miscellaneous13Act to bind Crown

This Act binds the Crown in right of New South Wales and, in so far as the legislative power of the Parliament of New South Wales permits, the Crown in all its other capacities.

14Regulations(1)

The Governor may make regulations, not inconsistent with this Act, for or with respect to any matter that by this Act is required or permitted to be prescribed or that is necessary or convenient to be prescribed for carrying out or giving effect to this Act.

(2)

The regulations may contain provisions of a savings or transitional nature consequent on the enactment of this Act.

(3)

Any such provision may, if the regulations so provide, take effect from the commencement of this Act or a later date.

(4)

To the extent to which any such provision takes effect from a date that is earlier than the date of its publication in the Gazette, the provision does not operate so as:

  • (a)

    to affect, in a manner prejudicial to any person (other than the State or an authority of the State), the rights of that person existing before the date of its publication, or

  • (b)

    to impose liabilities on any person (other than the State or an authority of the State) in respect of anything done or omitted to be done before the date of its publication.

15Amendment of other Acts(1)

The inclusion of Gulaga National Park in Schedule 14 to the National Parks and Wildlife Act 1974 by this Act is taken to have been made in accordance with the procedures provided in Division 7 of Part 4A of that Act.

Schedule 1State forest reserved as national park or state recreation area or dedicated as nature reserve

1Bangadilly National Park: Bangadilly State Forest No 881

An area of about 645 hectares, being Bangadilly State Forest No 881, dedicated 23 July 1943, and No 1 Extension thereto dedicated 4 December 1959, in the Parish of Bangadilly, County of Camden, and being the land designated as 160-01 on the diagram catalogued Misc R 00075 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

2Benambra National Park: Benambra State Forest No 667

An area of about 1,399 hectares, being Benambra State Forest No 667, dedicated 9 August 1918, in the Parishes of Mountain Creek and Woomargama, County of Goulburn, and being the land designated as 172-01 on the diagram catalogued Misc R 00001 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

3Bimberamala National Park(1)

An area of about 762 hectares, being the part of Currowan State Forest No 820, Nos 3 and 7 Extensions dedicated 30 August 1963 and 16 September 1977 respectively, in the Parishes of Currock and Currowan, County of St Vincent, and being the land designated as 161-01 on the diagram catalogued Misc R 00093 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

(2)

An area of about 2,555 hectares, being the part of Yadboro State Forest No 974, dedicated 6 April 1962, and the part of No 1 Extension thereto dedicated 26 August 1977, in the Parishes of Currock and Mogood, County of St Vincent, and being the land designated as 161-02 on the diagram catalogued Misc R 00093 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

10Addition to Conjola National Park: Conjola State Forest No 863

An area of about 7,282 hectares, being so much of Conjola State Forest No 863 as comprises the land designated as 85-01 on the diagrams catalogued Misc R 00082 (Third Edition) and Misc R 00083 (Third Edition), and the land identified as Lots 3 and 4 on the diagram catalogued Misc R 01019, in the Department of Environment and Climate Change, subject to any variations or exceptions noted on those diagrams. 13Additions to Deua National Park(1)

16Gourock National Park: Part Tallaganda State Forest No 577

2Part Kioloa State Forest No 828

An area of about 5 hectares, being the part of Kioloa State Forest No 828, dedicated 19 December 1930, in the Parish of Kioloa, County of St Vincent, and being the land designated as 25-98, on the diagram catalogued Misc R 00091 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

3Part Wandella State Forest No 1008

An area of about 1 hectare, being the part of Wandella State Forest No 1008, dedicated 20 July 1979, in the Parish of Wadbilliga, County of Dampier, and being the land designated as 48-99, on the diagram catalogued Misc R 00062 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

4Part Tallaganda State Forest No 577

An area of about 5 hectares, being the part of Tallaganda State Forest No 577, No 19 Extension dedicated 31 October 1980, in the Parish of Currambene, County of Dampier, and being the land designated as 164-99 on the diagram catalogued Misc R 00052 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

5Part Ournie State Forest No 402

An area of about 7 hectares, being the part of Ournie State Forest No 402, No 3 Extension dedicated 27 April 1984, in the Parish of Munderoo, County of Selwyn, and being the land designated as 822-99 on the diagram catalogued Misc R 00012 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

6Part Shoalhaven State Forest No 916

An area of about 5 hectares, being the part of Shoalhaven State Forest No 916, dedicated 7 July 1950, in the Parish of Nowra, County of St Vincent, and being the land designated as 872-99 on the diagrams catalogued Misc R 00080 (Third Edition) and Misc R 00081 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

7Part Meryla State Forest No 907

An area of about 8,500 square metres, being so much of Meryla State Forest No 907 as comprises the land designated as 22-99 on the diagram catalogued Misc R 00077 (Third Edition) in the Department of Environment and Climate Change, subject to any variations or exceptions noted on that diagram.

That area does not include the land identified as Lot 2 on the diagram catalogued Misc R 01033 in the Department of Environment and Climate Change.

8Part Termeil State Forest No 427

An area of about 1 hectare, being the part of Termeil State Forest No 427, No 1 Extension, dedicated 8 October 1920, in the Parish of Termeil, County of St Vincent, and being the land designated as 168-99 on the diagram catalogued Misc R 00090 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

9Part Travelling Stock Reserve 53971

An area of about 5 hectares, being the land designated as 98-99 on the diagram catalogued Misc R 00025 (Third Edition) in the Department of Environment and Climate Change, subject to any variations or exceptions noted on that diagram. However, that area does not include the land identified as Lot 7 on the diagram catalogued Misc R 01018 in the Department.

Schedule 6Changes within national park estate

(Section 11)

Part 1Revocation of national park and nature reserve and reservation as part of Gulaga National Park1Wallaga Lake National Park (to be added to Gulaga National Park)

The whole of Wallaga Lake National Park formally known as Wallaga Lake State Park and reserved by proclamation published in the NSW Government Gazette on 26 May 1972 and further reserved by proclamations published in the NSW Government Gazettes on 27 June 1975 and 11 April 1986 and containing an area of 1237.181 hectares.

2Goura Nature Reserve (to be added to Gulaga National Park)

The whole of Goura Nature Reserve formally known as The Goura Nature Reserve No 47 and dedicated by proclamation published in the NSW Government Gazette on 9 September 1966 and further dedicated by proclamations published in the NSW Government Gazettes on 9 July 1971, 24 April 1975, 22 May 1987 and 1 November 1996, exclusive of an area revoked by the National Parks (Special Provisions) Act 1988, and now containing an area of 560.2902 hectares.

Part 2Part of revoked Burrinjuck State Recreation Area reserved as part of Burrinjuck Nature Reserve3Burrinjuck Nature Reserve

That part of Burrinjuck State Recreation Area (being part of the area reserved by the proclamation published in the NSW Government Gazette on 29 April 1977 and further reserved by proclamations published in the NSW Government Gazettes on 30 March 1979, 1 February 1980, 6 May 1983 and 27 May 1983) containing an area of about 1,581 hectares, being the land designated as 560-01 on the diagram catalogued Misc R 00020 (Third Edition) in the New South Wales National Parks and Wildlife Service, subject to any variations or exceptions noted on that diagram.

Schedule 7Land transfers—ancillary and special provisions

(Section 12)

1Exclusion of freehold and certain leasehold interests(1)

Land that:

  • (a)

    a person holds for an estate in fee simple, or

  • (b)

    a person holds under a continued perpetual lease, continued special lease or continued term lease within the meaning of Schedule 1 to the Crown Land Management Act 2016, or

  • (c)

    is comprised of a continued incomplete tenure purchase within the meaning of Schedule 1 to the Crown Land Management Act 2016,

is not reserved or dedicated by the operation of this Act.

(2)

This clause has effect despite any other provision of this Act.

2Application of Act(1)

This Act has effect despite the provisions of the Forestry Act 1916 and, in particular, despite any different procedure for the revocation of State forests, flora reserves, national forests or timber reserves under that Act or the setting apart of flora reserves under that Act.

(2)

This Act has effect despite the provisions of the National Parks and Wildlife Act 1974 and, in particular, despite any different procedure for reserving or dedicating, or for vesting, land under that Act.

(3)

This Act has effect despite the provisions of the Crown Land Management Act 2016 and, in particular, despite any different procedure for dedicating land under that Act.

3Reservation of lands as national parks(1)

The lands reserved as national parks by this Act are, for the purposes of the National Parks and Wildlife Act 1974, taken to have been so reserved by proclamation made under section 33 (2) of that Act. A name assigned to any such national park by this Act is taken to have been assigned to that park by a proclamation referred to in section 36 (a) of the National Parks and Wildlife Act 1974.

(2)

The lands reserved as parts of national parks by this Act are, for the purposes of the National Parks and Wildlife Act 1974, taken to have been so reserved by proclamation made under section 33 (3) of that Act.

(3)

A reference in the National Parks and Wildlife Act 1974 to the publication of a proclamation under section 33 (2) or (3) of that Act is, in relation to a reservation effected by this Act, taken to be a reference to the enactment of this Act.

(4)

Section 35 of the National Parks and Wildlife Act 1974 does not apply to a reservation of land as, or as part of, a national park that is effected by this Act.

4Dedication of lands as nature reserve(1)

The lands dedicated as a nature reserve by this Act are, for the purposes of the National Parks and Wildlife Act 1974, taken to have been so dedicated by proclamation made under section 49 (1) of that Act. A name assigned to any such nature reserve by this Act is taken to have been assigned to that reserve by a proclamation referred to in section 51 (a) of the National Parks and Wildlife Act 1974.

(2)

The lands dedicated as part of a nature reserve by this Act are, for the purposes of the National Parks and Wildlife Act 1974, taken to have been so dedicated by proclamation made under section 49 (2) of that Act.

(3)

A reference in the National Parks and Wildlife Act 1974, being a reference to, or a reference to be construed as a reference to, the publication of a proclamation under section 49 (1) or (2) of that Act is, in relation to a dedication referred to in Part 2 of this Act, taken to be a reference to the enactment of this Act.

(4)

Section 35 of the National Parks and Wildlife Act 1974, as applied to nature reserves by section 58 (b) of that Act, does not apply to a dedication of land as, or as part of, a nature reserve that is effected by this Act.

5Reservation of lands as state recreation areas(1)

The lands reserved as state recreation areas by this Act are, for the purposes of the National Parks and Wildlife Act 1974, taken to have been so reserved by notice published under section 47B (1) (a) of that Act. A name assigned to any such state recreation area by this Act is taken to have been assigned to that area by a notice referred to in section 47F of the National Parks and Wildlife Act 1974.

(2)

The lands reserved as parts of state recreation areas by this Act are, for the purposes of the National Parks and Wildlife Act 1974, taken to have been so reserved by notice published under section 47B (1) (b) of that Act.

(3)

A reference in the National Parks and Wildlife Act 1974 to the publication of a notice under section 47B of that Act is, in relation to a reservation effected by this Act, taken to be a reference to the enactment of this Act.

(4)

Section 47D of the National Parks and Wildlife Act 1974 does not apply to a reservation of land as, or as part of, a state recreation area that is effected by this Act.

6Existing leases under Forestry Act 1916

Section 42 (2) of the National Parks and Wildlife Act 1974 applies to and in respect of a lease under the Forestry Act 1916, being a lease:

  • (a)

    affecting any of the lands described in Schedule 1, and

  • (b)

    current and in force immediately before the commencement of this Act,

in the same way as it applies to a licence or permit under the Forestry Act 1916, affecting lands within a national park.

7Administration of existing leases and similar interests(1)

In this clause, existing interest means a lease, licence, permit, authority, authorisation or occupancy current and in force immediately before the commencement of this Act.

(2)

The administration of matters relating to existing interests:

  • (a)

    to the extent that those interests affect any of the lands described in Schedule 1 or 2, or

  • (b)

    to the extent that those interests affect any of the lands described in Schedule 5 and are preserved by the operation of section 9,

is vested in the Minister administering the National Parks and Wildlife Act 1974.

(3)

For the purposes of subclause (2), the Minister administering the National Parks and Wildlife Act 1974 has:

  • (a)

    in respect of existing interests under the Forestry Act 1916—the powers of the Minister administering that Act and of the Forestry Corporation, and

  • (b)

    in respect of interests that were existing interests under the former Crown Lands Act 1989 or Crown Lands (Continued Tenures) Act 1989—the powers of the Minister administering the Crown Land Management Act 2016.

  • (c)

    (Repealed)

(4)

The amendments made to subclause (3) by the National Parks and Wildlife Amendment Act 2001 are taken to have had effect on and from the commencement of that subclause and anything done on or after that commencement under that subclause that could have been validly done under that subclause as so amended is taken to have been validly done.

8Special provision as to access roads within national parks etc(1)

In this clause:

access roads means the roads, tracks, trails and other means of access referred to in subclause (2) (a)–(c).

NPW Minister means the Minister administering the National Parks and Wildlife Act 1974.

private land holding means land held:

  • (a)

    by an owner within the meaning of the National Parks and Wildlife Act 1974, or

  • (b)

    as a holding within the meaning of the Crown Land Management Act 2016.

(2)

This clause applies to and in respect of the following access roads situated within the lands referred to in Schedule 1 or 2 immediately before the commencement of this Act:

  • (a)

    roads of access within the meaning of section 33A of the Forestry Act 1916,

  • (b)

    roads, tracks, trails and other means of access used, immediately before the commencement of this Act, for access to private land holdings within those lands,

  • (c)

    roads, tracks, trails and other means of access through those lands to State forests or private land holdings that adjoin or are in the vicinity of the lands.

(3)

The access roads to which this clause applies are not, on the commencement of this Act, reserved as, or as part of, a national park or state recreation area or dedicated as, or as part of, a nature reserve by the operation of this Act but vest in the NPW Minister on behalf of the Crown for the purposes of Part 11 of the National Parks and Wildlife Act 1974 for an estate in fee simple, freed and discharged from:

  • (a)

    all trusts, obligations, estates, interests, rights of way or other easements, and

  • (b)

    any dedication, reservation, Crown grant or vesting to which the lands were subject, and any such dedication, reservation, grant or vesting is revoked by the operation of this clause.

(3A)

For the avoidance of doubt, subclause (3) does not apply to land referred to in clause 1 (1). This subclause is taken to have commenced on the date of commencement of clause 1.

(4)

The access roads may continue, subject to this clause, to be used for the purposes for which they were used immediately before the commencement of this Act.

(5)

Before 30 June 2001, the NPW Minister must, under section 149 of the National Parks and Wildlife Act 1974, grant a right of way over an access road to which this clause applies for the benefit of a private land holding in order to replace any right of way duly granted under section 20A of the Forestry Act 1916 for the benefit of that landholding and in force immediately before the commencement of this Act. The NPW Minister may from time to time revoke or vary the grant of a right of way under this subclause.

(6)

Before 31 December 2007, the NPW Minister must, by one or more orders published in the Gazette, declare which of the access roads to which this clause applies:

  • (a)

    are excluded from reservation as part of a national park or state recreation area or dedication as part of a nature reserve, or

  • (b)

    are not so excluded and are reserved as part of the national park or state recreation area or dedicated as part of the nature reserve in which they are situated.

An order under this subclause may be published only with the concurrence of the Minister administering the Forestry Act 1916.

(7)

On the publication of an order under subclause (6):

  • (a)

    the access roads that are referred to in the order as excluded from reservation as part of a national park or state recreation area or dedication as part of a nature reserve remain vested in the NPW Minister for the purposes of Part 11 of the National Parks and Wildlife Act 1974 and may, subject to this clause, continue to be used for the purposes for which they were used immediately before the commencement of this Act, and

  • (b)

    the access roads that are not so excluded are reserved as part of the national park or state recreation area or dedicated as part of the nature reserve within which they are situated.

(8)

Nothing in this clause affects the exercise of any power, authority, duty or function by the NPW Minister or any other person under and in accordance with the National Parks and Wildlife Act 1974 in relation to any access road to which this clause applies.

(9)

While a private land holding is in private ownership, nothing in this clause authorises the NPW Minister to close any access road that comprises the only practical means of access to the land holding.

(10)

This clause has effect despite the provisions of the Forestry Act 1916.

(11)

Despite subclause (3), every right of way over an access road to which this clause applies that was duly granted under section 20A of the Forestry Act 1916 for the benefit of a private land holding and was in force immediately before the commencement of this Act (other than the rights of way referred to in subclause (16)) is taken to have continued in force as if it were granted under section 149 or 153 of the National Parks and Wildlife Act 1974 (as the case requires).

(12)

A right of way taken to have continued in force by subclause (11) may, from time to time, be revoked or varied by the Minister administering the National Parks and Wildlife Act 1974 without agreement or consent (however expressed) of the beneficiary of the right of way.

(13)

As soon as practicable after the commencement of subclause (11), the Minister administering the National Parks and Wildlife Act 1974 must cause notice of that commencement and the effect of that commencement to be given to each beneficiary of a right of way taken to have continued in force by that subclause.

(14)

The provisions of subclauses (11) and (12) have effect despite anything contained in section 42 of the Real Property Act 1900.

(15)

The Registrar-General may, on application by the Director-General, make a recording in the Register kept under the Real Property Act 1900 to signify that:

  • (a)

    a right of way is taken to have continued in force under subclause (11), or

  • (b)

    such a right of way has been revoked or varied under subclause (12).

A recording is to be made in the manner that the Registrar-General considers appropriate to give effect to the right of way (or the revocation or variation of the right of way).

(16)

Subclause (11) does not apply to the following rights of way:

  • (a)

    a right of way that, before the commencement of this clause, has been replaced by a similar right of way granted in accordance with subclause (5),

  • (b)

    a right of way over land that, before the commencement of this clause, has been transferred from the Minister administering the National Parks and Wildlife Act 1974 to another person.

9Status of land vested in NPW Minister(1)

Any land that is vested by this Act in the Minister administering the National Parks and Wildlife Act 1974 for the purposes of Part 11 of that Act is taken to have been acquired by that Minister under that Part, and may be dealt with by that Minister as if it had been so acquired.

(2)

Any such land is, to the extent that it relates to land subject to a lease preserved by the operation of section 9, taken to be Crown lands reserved from sale for the purpose of any application by the holder of the lease to purchase the land comprised in the lease.

10Setting apart of flora reserves

The lands set apart as, or as part of, a flora reserve under this Act are, for the purposes of the Forestry Act 1916, taken to have been set apart by notice under section 25A of that Act. A name assigned to any such flora reserve by this Act is taken to have been assigned to that flora reserve by a notice under that section.

11Access roads over dedicated Crown land

The following provisions apply to access roads referred to in clause 8 (2) (a)–(c) within the lands referred to in Schedule 4 immediately before the commencement of this Act:

  • (a)

    the access roads may continue, subject to this clause and the Crown Land Management Act 2016, to be used for the purposes for which they were used immediately before the commencement of this Act,

  • (b)

    the National Parks and Wildlife Reserve Trust may not close any such access road while it comprises the only practical means of access to a private land holding (within the meaning of clause 8),

  • (c)

    the National Parks and Wildlife Reserve Trust may, in accordance with the Crown Land Management Act 2016, grant any right over, or interest in, the land for the purpose of its continued use as an access road.

12Saving in relation to revocations

A revocation effected by this Act does not affect anything done or omitted to be done before the commencement of this Act.

13Sewage treatment facilities on land added to Conjola National Park and on land in proposed Kangaroo River Nature Reserve(1)

In this clause:

relevant acquiring authority means any person or body that is authorised to acquire land for the purposes of a sewage treatment facility by compulsory process in accordance with the Land Acquisition (Just Terms Compensation) Act 1991.

the Principal Act means the National Parks and Wildlife Act 1974.

(2)

A relevant acquiring authority may acquire, by compulsory process, land for the purposes of a sewage treatment facility, comprising either or both of the following:

  • (a)

    an area (not exceeding 6 hectares) within Conjola National Park that adjoins Red Head Road (also known as Bendalong Road),

  • (b)

    an area (not exceeding 6 hectares) within Kangaroo River Nature Reserve that adjoins Bendeela Road.

(3)

The Director-General of National Parks and Wildlife may authorise a relevant acquiring authority to conduct surveys and investigations of an area of land referred to in subclause (2) for the purposes of determining the location of a sewage treatment facility.

(4)

Land cannot be acquired under this clause unless the acquisition is approved by the Minister administering the Principal Act.

(5)

The acquisition of an area of land in accordance with this clause operates to revoke the reservation or dedication of that area of land under the Principal Act as national park or nature reserve.

(6)

This section has effect despite anything to the contrary in the Principal Act.

(7)

Land may only be acquired under this clause before 31 December 2010.

14Widening and re-aligning of Naval College Road(1)

In this clause:

relevant acquiring authority means any person or body that is authorised to acquire land for the purposes of a road in accordance with the Land Acquisition (Just Terms Compensation) Act 1991.

the Principal Act means the National Parks and Wildlife Act 1974.

(2)

A relevant acquiring authority may acquire, by compulsory process, land for the purposes of widening or re-aligning Naval College Road in Jervis Bay National Park, comprising any part of the area identified as 90-01 on the diagram catalogued Misc R 00087 in the New South Wales National Parks and Wildlife Service.

(3)

The Director-General of National Parks and Wildlife may authorise a relevant acquiring authority to conduct surveys and investigations of an area of land referred to in subclause (2) for the purposes of determining the location of any addition to or re-alignment of Naval College Road.

(4)

Land cannot be acquired under this clause unless the acquisition is approved by the Minister administering the Principal Act.

(5)

The acquisition of an area of land in accordance with this clause operates to revoke the reservation of that area of land under the Principal Act as national park.

(6)

This section has effect despite anything to the contrary in the Principal Act.

(7)

Land may only be acquired under this clause before 31 December 2010.

15Special provisions relating to Burrinjuck State Recreation Area(1)

This clause has effect for the purposes of section 11 (2).

(2)

The land referred to in section 11 (2) (b) (the Burrinjuck State Recreation Area) immediately before the repeal day continues on and from that day to be Crown land dedicated under the Crown Land Management Act 2016 for the purposes of public recreation.

(3)

Clause 11 of Schedule 7 to the Crown Land Management Act 2016 operated on the repeal day:

  • (a)

    to abolish the Burrinjuck Waters State Park Trust, and

  • (b)

    to replace it with a statutory land manager under that Act, and

  • (c)

    to appoint the members of the trust board of the Burrinjuck Waters State Park Trust as members of the board of the statutory land manager, and

  • (d)

    to appoint the statutory land manager as the Crown land manager of the land comprised by the Burrinjuck State Recreation Area.

(4)

In this clause:

repeal day means the day on which the Crown Lands Act 1989 is repealed by the Crown Land Management Act 2016.

16Exclusion of Crown lands subject to pending Aboriginal land rights claims

Crown land that is the subject of a claim duly made under Division 2 of Part 6 of the Aboriginal Land Rights Act 1983 before 14 April 2000, being a claim that has not been determined before the commencement of this Act, is not reserved or dedicated by the operation of this Act.
