Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the National Occupational Health and Safety Commission Act 1985.

Citation

 1. T  hese Regulations may be cited as the National Occupational Health and Safety Commission (Allowances) Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

Interpretation

 2. In these Regulations, unless the contrary intention appears:

“committee” means a committee constituted under section 25 of the Act;

“the Act” means the National Occupational Health and Safety Commission Act 1985.

Allowances for expenses

 3. (1) If a member of the Commission, other than the Chairperson or the Chief Executive Officer, travels with the approval of the Chairperson for the purposes of the Commission, the Executive, a committee or a working party, an allowance is payable in respect of the expenses of the member for the travel as if travelling allowance payable to a Senior Executive Service officer of the Australian Public Service were payable to the member.

 (2) If a member of a committee, or of a working party, who is not a member of the Commission, travels with the approval of the Chairperson for the purposes of the committee or working party, an allowance is payable in respect of the expenses of the member for the travel as if travelling allowance payable to an officer of the Australian Public Service, other than the Secretary to a Department or a Senior Executive Service officer, were payable to the member.

 (3) A reference in subregulation (1) to a member of the Commission includes a reference to a person who:

  • (a)

    is appointed under subsection 11 (1) of the Act to be the alternate of a member of the Commission; and

  • (b)

    travels with the approval of the Chairperson to attend a meeting of the Commission as the alternate of the member.

 (4) Subregulations (1) and (2) do not apply to:

  • (a)

    a member of, or a candidate for election to, the Parliament of the Commonwealth, the Parliament of a State or the legislature of a Territory; or

  • (b)

    an officer or employee of the Commonwealth or of a Commonwealth authority.

Repeal

 4. Statutory Rules 1985 No. 385 are repealed.
