Application for approval of the NHVR (Operational and On-Road Regulatory Compliance) Enterprise Agreement 2020-2022.

[1] An application has been made for approval of an enterprise agreement known as the NHVR (Operational and On-Road Regulatory Compliance) Enterprise Agreement 2020-2022 (the Agreement). The Application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by National Heavy Vehicle Regulator. The Agreement is a single enterprise agreement.

[2] Upon receiving the application, my chambers wrote to the parties advising that there appeared to be a typographical error at clause 32.1 and proposing I exercise power under s.586 to correct the typographical error. The parties were invited to provide their views and were agreeable to the proposal. I consider it appropriate to exercise power under s.586 of the Act to correct the typographical error in clause 32.1.

[3] The Australian Municipal, Administrative, Clerical & Services Union (ASU) and the Community and Public Sector Union (CPSU) lodged a Form F18 statutory declaration supporting approval of the Agreement and giving notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) of the Act, I note the Agreement covers the ASU and the CPSU.

[4] The Agreement is approved and will operate in accordance with s.54 of the Act.
