I, NICOLA ROXON, Minister for Health and Ageing, make this Determination under subsection 35 (1) of the National Health Security Act 2007.

1              Name of Determination

This Determination is the National Health Security (SSBA Standards) Amendment Determination 2009 (No. 1).

2              Commencement

This Determination commences on 1 July 2009.

3              Amendment of National Health Security (SSBA Standards) Determination 2008

   Schedule 1 amends the National Health Security (SSBA Standards) Determination 2008.

3.3           Authorised persons

The entity shall authorise persons to handle SSBAs, to access the facility where SSBA are handled and/or access sensitive information related to the SSBAs. The Responsible Officer shall maintain a list of these authorisations.

Authorised persons shall:

(a)    have been trained in the requirements of the NHS Act, the NHS Regulations and these Standards

(b)    have signed, dated and provided to the Responsible Officer a record of the training referred to in (a) above

(c)    not have been excluded from handling SSBAs by the entity nor directed not to handle SSBAs by the Secretary of the Department of Health and Ageing.

Students who handle SSBAs shall become either authorised persons or approved persons (see Clause 3.5) depending on the requirements of the facility.

3.4           Recruitment

The entity shall ensure that the identity, qualifications and experience of all persons recruited for the purpose of handling SSBAs are assessed as part of the recruitment process.
