National Health Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the National Health Act 1953.

1.   Amendment

1.1   The National Health Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts InterpretationAct 1901, s.48]

2.   Regulation 3e (Nursing care at home in lieu of hospital treatment—modifications of section 4 of the Act)

2.1   Omit the regulation.

3.   New regulation 4b

3.1   After regulation 4a, insert:

Nursing care at home instead of hospital treatment—modifications of section 4 of the Act

“4b. Until 1 March 1993, section 4 of the Act, in its application to the registered health benefits organisations specified in Schedule 3, has effect subject to the modifications set out in Schedule 4.”.

4.   Regulation 48 (Prescribed business—definition of “health insurance business” in subsection 67 (4) of the Act)

4.1   Subparagraph 48 (1) (a) (ii):

Omit the subparagraph, substitute:

 “(ii) a person who is a resident of Australia and engaged in temporary employment outside Australia, or a dependant of that person, in respect of whom a contract of insurance provides that liability for hospital treatment or an ancillary health benefit may arise:

 (a) in Australia; or

 (b) outside Australia, if the absence of the person from Australia is due to the temporary employment; or”.

5.   Schedule 3 (Registered health benefits organisations)

5.1   Omit the heading, substitute:

“SCHEDULE 3

Regulation 4b

 

REGISTERED HEALTH BENEFITS ORGANISATIONS”.

6.   Schedule 4 (Modifications of section 4 of the Act)

6.1   Omit the heading, substitute:

“SCHEDULE 4

Regulation 4b

 

MODIFICATIONS OF SECTION 4 OF THE ACT”.
