Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Health Act 1953.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the National Health (Pharmaceutical Benefits) Regulations.

Interpretation

2. Regulation 5 of the Principal Regulations is amended by omitting from sub-regulation (1) the definition of “approved pharmaceutical chemist” and substituting the following definition:

“ ‘approved pharmacist’ means a pharmacist for the time being approved under section 90 of the Act;”.

Writing of prescriptions

3. Regulation 19 of the Principal Regulations is amended—

(a) by omitting from sub-regulation (1a) “(1) (b)” and substituting “(1) (h)”; and

(b) by omitting from paragraph (2) (c) “both or” and substituting “both of”.

Supply of pharmaceutical benefits on prescription

4. Regulation 21 of the Principal Regulations is amended by omitting from sub-regulation (1) “or participating dental practitioner”.

Receipts

5. Regulation 31 of the Principal Regulations is amended by omitting from paragraph (1) (a) “or a repeat authorization” and “or repeat authorization” and substituting “, a repeat authorization or a deferred supply authorization” and “, repeat authorization or deferred supply authorization”, respectively.

Retention of prescription, &c.

6. Regulation 32 of the Principal Regulations is amended by omitting sub-regulation (2).

Minor amendments

7. (1)The heading to Part II of the Principal Regulations is amended by omitting “CHEMISTS” and substituting “PHARMACISTS”.

(2) The Principal Regulations are further amended as set out in the Schedule.

 

SCHEDULE Sub-regulation 7 (2)

FURTHER AMENDMENTS OF NATIONAL HEALTH (PHARMACEUTICAL BENEFITS) REGULATIONS

The Principal Regulations are amended by omitting from each of the following provisions “pharmaceutical chemist” (wherever occurring in that provision) and substituting “pharmacist”:

Regulation 8; paragraph 8a (1) (b); regulations 9, 16, 17 and 18; sub-regulations 18a (1), 19 (3), 19a (3), 21 (1), 21 (2), 22 (1), 22 (2), 22 (3), 22 (4) and 22 (5); regulation 23; paragraph 24 (b); sub-regulations 26 (1), 26 (2), 26 (3), 26a (1), 26a (2), 26a (3), 27 (1), 27 (2), 28 (1) and 28 (2); regulation 30; sub-regulations 31 (1a), 31 (2), 31 (3), 32 (1) and 32 (1a); regulations 33 and 34.
