PHARMACEUTICAL BENEFITS

AMENDMENT DETERMINATION UNDER SUBSECTION 84C (7) No. 2

I, Susan Leigh Campion, Assistant Secretary, Community Pharmacy Branch, Department of Health and Ageing and delegate of the Minister for Health and Ageing, make this determination under subsection 84C(7) of the National Health Act 1953 having in accordance with subsection 84C(9) of the National Health Act 1953, obtained the written agreement of the Pharmacy Guild of Australia.

Name of Determination¹

This Determination is the National Health Act 1953 Pharmaceutical Benefits Amendment Determination under subsection 84C(7) No. 2.

Commencement

This Determination commences on 1 August 2008.

Amendment of the Determination under subsection 84C(7)

The Schedule amends the National Health Act 1953 Pharmaceutical Benefits Determination under subsection 84C(7) made on 14 June 2006.

Schedule - Amendments

[1] Paragraph 3

insert:

“pharmaceutical item” has the same meaning as in section 84AB of the Act;

[2] Paragraph 3

omit:

“ready-prepared pharmaceutical benefit” means a pharmaceutical benefit in respect of which there is a determination (as amended from time to time) made under subsection 85 (6) of the Act in force on the day on which this determination is made;

substitute:

“ready-prepared pharmaceutical benefit” means a brand of a pharmaceutical item in respect of which there is a determination (as amended from time to time) made under subsection 85 (6) of the Act in force on the day on which this determination is made;
