DETERMINATION UNDER SECTION 93

I, JOAN CORBETT, Assistant Secretary, Pharmaceutical Benefits Branch, Department of Health and Ageing and Delegate of the Minister for Health and Ageing, pursuant to section 93 of the National Health Act 1953, hereby make the following Determination:
This Determination commences on 1 August 2005.
Determination No. PB 6 of 2005 under section 93 of the National Health Act 1953, made on 22 March 2005 with effect from 1 April 2005, is repealed.
The pharmaceutical benefits referred to in this Determination shall be those specified in the Schedule to this Determination.
A medical practitioner is authorised for the purpose of section 93 of the National Health Act 1953 to supply any of the pharmaceutical benefits obtained by the medical practitioner, or by another medical practitioner for whom the first-named medical practitioner is temporarily acting as a locum, in pursuance of this Determination.
Subject to this Determination, the maximum quantity or number of units of a pharmaceutical benefit which may be obtained by a medical practitioner in any one month for the purpose of section 93 of the National Health Act 1953 is the quantity or number specified in the Schedule to this Determination in relation to the pharmaceutical benefit.
Where a medical practitioner has obtained a pharmaceutical benefit for the purpose of section 93 of the National Health Act 1953, that medical practitioner is not entitled to obtain a further quantity or number of units of that pharmaceutical benefit for that purpose whilst in possession of a quantity or number of units of the pharmaceutical benefit obtained by the medical practitioner equal to or greater than the maximum quantity or number of units allowed for the pharmaceutical benefit by paragraph 5.
