Determination — Price determinations and special patient contributions
(PB 18 of 2010)

Commencement [see Note 1]

1.       This instrument commences on 1 April 2010.

Repeal

2.       Instrument number PB 118 of 2008 is repealed.

Definition

3.       In this Determination “authority prescription” means a prescription which directs the supply of a pharmaceutical benefit and is a prescription authorised by, or taken to have been authorised by, the Chief Executive Officer of Medicare Australia in accordance with paragraph 12 of the determination made for the purposes of subsection 85A(2) of the Act.

Determined price

4.       For subsection 85B(2), the amount that is taken to be the appropriate maximum price for sales to approved pharmacists of a brand of a pharmaceutical item in Schedule 1 for the quantity or number of units mentioned for the brand is the price for that brand specified in the column headed “Determined price”.

Claimed price

5.       For subsection 85B(3), the amount that is taken to be the price claimed by the responsible person as the responsible person's price for sales to approved pharmacists of a brand of a pharmaceutical item in Schedule 1 for the quantity or number of units mentioned for the brand is the price specified in the column headed “Claimed price”.

Circumstances

6.       For the purposes of subsection 85B(5), the circumstances in which the Commonwealth is to pay the special patient contribution for brands of pharmaceutical items mentioned in Schedule 2 are that the brand has been supplied on an authority prescription.
