1 Name of Instrument
(1)This Instrument is the Amendment determination under paragraph 98C(1)(b) of the National Health Act 1953.
(2)This Instrument may also be cited as PB 75 of 2012.
2 Commencement
This instrument commences on 1 October 2012.
3 Amendments to Determination under paragraph 98C(1)(b) of the National Health Act 1953 (PB 119 of 2008)
Schedule 1 amends the Determination under paragraph 98C(1)(b) of the National Health Act 1953 (PB 119 of 2008).
Schedule 1 Amendments
[1] Section 3
omit:
“approved price to pharmacists” has the same meaning as in subsection 98B(3) of the Act;
substitute:
“approved ex-manufacturer price” has the same meaning as in subsection 84(1) of the Act;
Section 3
insert after definition of “extemporaneously-prepared pharmaceutical benefit”:
“pack quantity” has the same meaning as in subsection 84(1) of the Act;
Section 3
insert after definition of “prescription”:
“proportional ex-manufacturer price” has the same meaning as in subsection 84(1) of the Act;
[4] Section 5
omit:
approved price to pharmacists for that brand
substitute:
approved ex-manufacturer price or proportional ex-manufacturer price for a pack quantity of that brand
[5] Section 6
omit:
approved price to pharmacists
substitute:
approved ex-manufacturer price or proportional ex-manufacturer price for a pack quantity
[6] Section 9
omit:
paragraph 38 of the determination made under subsection 98B(1) of the Act
substitute:
section 31 of the determination made under paragraph 98B(1)(a) of the Act
[7] Section 9
omit:
paragraph 21 of the determination made under subsection 98B(1) of the Act
substitute:
section 18 of the determination made under paragraph 98B(1)(a) of the Act
[8] Schedule 4, after entry for Carbomer
insert:

[9] Schedule 4, entry for Risedronic acid and calcium with colecalciferol
omit from the column headed “Form, (strength, type, size, etc.)”:
| Pack containing 4 tablets risedronate sodium 35 mg and 24 sachets containing granules of calcium carbonate 2.5 g with colecalciferol 22 micrograms |
