[4] The undertakings meet the requirements of s.190(3) of the Act and I have accepted them. As a result, the undertakings are then to be a term of the Agreement and are attached to this Decision as Attachment A.

CaseChat Overview and Summary
The primary legal issues before the court were whether the agreement complied with the Fair Work Act 2009, and whether the agreement was appropriately made and negotiated in good faith. The court had to assess the procedural fairness of the bargaining process, the coverage of the agreement, and the substantive terms of the agreement, including pay rates, working conditions, and other employee entitlements.
The court examined the evidence presented, including the bargaining process and the terms of the agreement. It found that the agreement was made in good faith and followed the necessary procedural requirements under the Act. The court was satisfied that the agreement covered all relevant employees and that it provided fair and reasonable terms for the employees. The court approved the agreement, finding it to be in the best interests of the employees.
The court made orders approving the National Glass Pty Ltd Brisbane Enterprise Agreement 2021, effective from the date of the court's approval. The agreement was to be registered with the Fair Work Commission, and the parties were directed to comply with the terms and conditions as set out in the approved agreement.
