Explanatory note
The object of this Regulation is to amend the National Energy Retail Law (Adoption) Regulation 2013 to confer the current exemption for Delta Electricity from the National Energy Retail Law (NSW), relating to the BHP Port Kembla Slab and Plate Products Contract, on Sunset Power International Pty Ltd (the new owner of Delta Electricity).
This Regulation is made under the National Energy Retail Law (Adoption) Act 2012, including section 12
(the general regulation-making power), and under section 3B of the National Energy Retail Law (NSW).

1      Name of Regulation

This Regulation is the National Energy Retail Law (Adoption) Amendment (Delta
Electricity) Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of National Energy Retail Law (Adoption) Regulation 2013

Clause 14 Exemption of Sunset Power International Pty Ltd for BHP contract

Omit “Delta Electricity” wherever occurring in clause 14.
Insert instead “Sunset Power International Pty Ltd (ACN 162 696 335)”.
